Loaded ice cream at a cold storage in Massachusetts, bound for places in Maine. Set the reefer for -20, and off I go. First place is a little joint west of Kennebunk - have to fork a pallet jack into the trailer to get it off. So after helping out, the receiver comes back and says he has half a pallet he is refusing. It's discontinued product he didn't order. Ok...
So finish my other two stops, and claims tells me to take it back, which I do. I get a door, and after a bit one of the freezer-heads comes out, tells me they can't take the product back. Why's that, I ask? It's melted. Say what??? Reefer was on -20 all day. So I wait a few minutes, go in and tell them I need access to their dock because claims wants pictures to document the condition of the goods. So I start taking pics, and pretty soon freezer-head comes out with a signed bill accepting the return.
The ice cream was good n' frozen still... they just didn't want to get stuck with a discontinued product that no one wanted.KB3MMX Thanks this. -
Hum the quistion is box trl driver's smarter then flatbed drivers, i did this once , flatbed was parked next me , took his tarps, stowed away neetly behind my tractor, went in behind the store area too bultin board, i posted i had slighty used tarps for sale , after the cb went quite as he was asking around
, he went in too eat, he past the ad, called me up
and sold him his own tarps back,
but the moral of this story is he was my best freind and we always jokes around like this on each other and now every time i see him i ask him how tarp are s doing, are they flying away,as i start too laugh
he says nope , i got big chain and padlock and locks on all the doors now, o the fun we used too have with the wateress too, Everett.

When the reciever comes back and refuses the half load you've got left in the trailer for what ever reason tell them to load back on what they just took off, as the front half is the same as the back half, and you'll take it to the________(fill in the blank), they'll take the rest off, usually its an over order on their part so they just take off what they want and tell you the rest is cold,hot,bugs,soft, whatever.

You can call the USDA all you want.I'm sure they are going to race right down to Pathmark and get to the bottom of it.The customer may have stricter standards than the USDA requires.They are paying for the freight, not the USDA.If they want their oranges all to have three leaves on them, they can refuse any that dont'.Regardless if the USDA says the two leaved oranges are chock full of ''orangey goodness'' and are fit for human consumption.Tough luck,it doesn't have three leaves.They don't want it.They don't have to take it either.
The carrier can take them to court and persue legal remedies to recover their freight charges all they want and will probablly do so.Even in the unlikely event the USDA does show up, it lacks the authority to force any business to accept ANY freight THE RECIEVER determined does not meet THEIR standards.The carrier can present the USDA findings to a court,to prove that the load hadn't spoiled,but that's about it.
A lot of your posts have the usual,unimaginative right wing talking points in them.Almost verabatim from Rush Limbaugh.You and a lot of other people on here are always carrying on about Socialism and the like.Yet one basic tenet of Capitalism seems lost on you.That would be,the customer is always right..

I've had pallets of spuds refused because the forklift operator ripped some of the bottom bags and the customer refused them.Maybe I should have called the USDA.(rollls eyes)
I've never had a freight claim because of temperature issues.More often than not, it was because of damage that occured while the trailer was being unloaded.Or an occasional overage of a product the customer didn't want..
I know there was not yogurt all over the floor and smeared right around the level of a forklift..What are you gonna do? One more of the delightful perks to being an OTR driver.Sometimes you get some free yogurt to eat while your waiting in line at the Streaking Beacon to get yogurt washed out of the reefer.. -
Yeah, it doesn't have to be a union shop for them to have the same mentality and/or usefulness.
