Ok I was involved in a rollover accident on June 12th

    Post accident drug and alcohol are required if:

    Fatality - must do, no question

    Injury requiring treatment away from the scene and/or vehicle damage requiring towing

    AND

    the driver receives a citation [ticket]

    However:

    there is a time limit of 8 hours for the BAC and 32 hours for the urinalysis and the onus is onthe carrier to get this done in the time frame, if possible, otherwise they need to document why it wasn't done.

    End of story; it is NOT a refusal to test.

    Time to upgrade to the GPS/ spot lock version with the min kota remote control.

    I know 3 people who rolled trucks and they were all tested at the hospital.

    Way too many loose ends the OP has. And when question about it, seems me makes even more loose ends up as he goes along. What’s catches my eye is he claims at the hospital they took blood and urine, for what ? And then he claims the clearing house never received it. o_O Okay……….

    probably at the PD request.

    The last fatal I handled the driver was released at the scene but the truck was towed to impound and the port authority PD called to make sure we were getting him tested. His bro in law [another Lease Op] picked him p and was taking him directlyto a clinic right in Elizabeth; I set that up just before they called....

    DOT post accident tests results require the driver's writen consent before I could release them to the PD. they got him the papers to sign overnight and were at my door that after noon.

    You're probably going to eat that money unfortunately. The money it took for them to call a wrecker, thousands of bucks, they'll probably keep that check. You didn't make the test, so it's a refusal and you'll have to go through thr return to duty process. That's the only way to fix it. You'll need to start your career all the way over.
