okay this is my situation....

    I graduated truck driving school. Then went with Werner(stupid mistake) they didn't care to see me succeed and basically jerked me around for 3 months. Then I went with Swift(another stupid mistake) they trained me and I was doing fine but I was starving to death and couldn't pay my bills because I was getting 300 mile runs a week. I have a accident on my dac report with Werner but not on my driving record.(I was idling in an O/O truck and bumped the gear shift on accident and it jumped into gear into a tree.)I just found out the other day that Swift put one on my report too although I never had one! I just got laid off from a moving company because work got slow and now I'm unemployed. I really enjoy driving a truck. I would love to do it for the rest of my life but my past experiences keep getting me a bunch of no's from prospective employers....what do I do? Am i screwed?

    About the accident.

    Did you not have the brakes set?

    Was the O/O's truck an automatic?

    Hello CPF and welcome to the forum. I don't know what to tell you about your past job history and the accidents shown.

    But I can tell you that your next job, (and there WILL be another driving job for you if you keep looking,) STICK WITH IT for a year or two. I know that it can be hard to do.

    When you are a newbie, companies can and do jerk you around. And it really makes the grass look greener somewhere else. But as you found out, that somewhere else, once you get inside of it, is just more of the same old BS. You need at least a couple of years of good solid employment here, with no more accidents or incidents.

    It's not an easy life you are trying to break into here. Do NOT expect any company to really give a #### about you, your wants, needs, desires.

    Yes brake was set. No not an automatic just a piece of crap that never got maintained correctly. Werner didn't even believe me when i told them what happened I offered to demonstrate but they declined.

    You made as big a mistake leaving those companies as you did choosing them. You should have researched and know what to expext and been willing to weather the bad times when you went to them.

    I agree with Big Don you will get another chance. It may well be with a worse company than you have been with so far. Each bad choice you make limits your possibilities. If you don't stick with the next one for a year regardless of the bad times, it may well be your last chance.

    You may have to look outside the box now. Try smaller companies that don't care about DAC. Stay away from online interviews you can't compete with the drivers who have no dings. Practice selling yourself. Try to do phone or in-person interviews. You have to convince someone, in a position to do so, to give you a chance. That can only be done through selling yourself and with a more personal interview. Knocking on doors and timing will be trump. Find a company needing drivers bad, they often relax hiring standards when the need is high.

    Call the dac report office at hire right and file a complaint. Keep looking for a job any job. File for unemployment and never give up. Keep your driving record clean from now on a must in order to keep your cdl active. If you have to wait a certain amount of time(to be able to drive) say 3 years or less before the companies u worked for will remove the accidents then find out by calling them and asking this info. Call the local Dmv office and find out if these accidents are on your mvr report. If so find out how long from them will they be reporting it. On the false report of accident from swift file a complaint with the dac report on that. If u know the safety officer's from these 2 companys. Ask if they could fill out a form and have these accidents removed from your dac report. By up dating a form all employer's fill out and report info on the driver's that work for them or have work for them in the past. If u have to wait the time out make sure your employed some where. This will help when your able to start driving again. Can not have gap in employment. If u need a refesher to start back to work if your out of the truck over a year or more covenant offers one for free. God Bless & keep u and family safe help someone else;)

    a few things
    1st it's AUTOSHIFT not automatic
    2nd an autoshift requiers you push the brake (30psi) or it will not go into gear
    3rd even in gear an autoshift requiers the rpm to be at or above 700 before the clutch starts working, at idle in gear it will not move the truck.

    if it's an older autoshift that has the clutch pedal it will not go into gear unless you first push the clutch

    IMHO, it could only happen in a manual transmission and it would take some serious force to knock it into gear. Then the brakes would have to be so poorly adjusted that it would have trouble stopping.

    What we are telling you is while this story may be true, it's a rare case where a lie might work better. Nobody is going to believe it, true or not. The most important part of overcoming your mistakes is taking responsibility for them and taking your lumps.

    You won't get hired if they think you are lying. With all due respect the most important word in the last sentence was think. I'm not accusing you of anything. How your story is perceived is more important than the truth.

    Remember there are always at least three truths and they are all different. They are your truth, my truth and THE truth.
