If the suspension is upheld there is no way around retesting. The stay only pauses the suspension until the appeal is decided. It does not cancel the penalty or protect the CDL. Once the final ruling is made the penalties apply and the driver must start over.Rideandrepair Thanks this. -
In most states the charge is called "Actual Physical Control" of a motor vehicle, or just APC. If someone is found passed out in the driver's seat with the keys in possession or in ignition, for example. Don't know what the mvr thinks about it but to insurance companies it's still a DUI.Stringb8n, Rideandrepair and BrothaTrucka513 Thank this.

So the moral of the story is, if police knock on the door just don’t answer. Would have saved the guy a lot of trouble.

That's because he wanted to get to the bottom of the story, now that you've been more forthright with it, one can only wonder
a cousin of mine was also asked to leave a bar/ pub and refused to do so, the police were called and they took him away and locked him up in the police lock up for the night, it went to court and he was banned from drinking at all clubs/ bars in the area for 6 months plus a fine. I do wish you well in the future, with video evidence one can understand why the police would of come to your residence while you were no longer driving you had done so prior to that, saying that your now at home does not excuse the fact that at some point you were driving under the influence, now if you were below .08 you would of been fine, refusing to do a blood alcohol test will result in your being charged with DUI the difference being as they don't actually know how much over the limit you were it would be hard to decide what the penalty would be e.g if a driver was .06 compared to being .15
