Was leased on to a company for 8 years 7 months. Leased a truck from Freightliner . Needed to get closer to home, miles cut back to 2,500 week, and didn't pay well. I quit, my contract was at will, any time either party
could terminate it for any reason. My truck contract stated the lease depended on my employment with that
carrier, if I left the truck had to be returned. That is exactly what I did, I did not make the decision, without a great deal
of thought, knowing that I was in for the BIG BILL for turning in the truck. Fine. The problem I'm having is with the Company I was leased to. The people there came unglued. I called ahead to arrange turning in the plate and ELD. everything was fine. Showed up dropped it off , these guys went absolutely bezurk, I owed a
balance ,told them it would be paid just not today, and left saying SEE YA , to get away from them trying to force me to stay, left went to the truck stop, and he boss followed me to harass me, I confronted him
and the argument continued, Him promising to make sure I NEVER work again
Got on with another carrier, 3 weeks and got terminated. Was running for some agents in Portland, they told
me he said I was fired and hit a bridge, and got into 7 accidents in the past year, their report on my Hireright
DAC report said other wise, I did challenge the Dack and dates comments came back changed from the original report.
NO EXCUSE I have ruined trailer wheels and tires over the past 4 years, and caught the back of the trailer
coming around corners, as well as a non-preventable getting sideswiped in the truck, 3 in the past 3 years
7 altogether
The companies all get my DAC , as well as my application and approve me, till they get a call form the
x-boss
I got a different truck to get on with the last company, and am about to loose it , need someone to lease
to that will not terminate me because of this person, any ideas? Helpful advice would be greatly
appreciated. Don't really need the crap right now so keep it, to your self THANKS

What is DACK??whoopNride Thanks this. -
DAC. It's a report of the driver. Mvr, plus any wrecks the subscribing company puts on there.
The fact he states he went through their resolution process and still gets the name wrong tells me he is likely just a troll.
That and leasing for eight years and still not owning the truck...Last edited: Nov 17, 2018
Opendeckin Thanks this. -
I owned 2 trucks there at that company before I leased the third, and yes it is DAC. am no troll, he came unglued when he saw this truck, no reason my truck lease was through Freightliner, and yes, like I said NO EXCUSE but that is the situation I am dealing with right now, the companies get my DAC, and they clear &
approve me, with the accidents on it as well as my application
thanks guys for the replysLast edited: Nov 18, 2018

There are laws against such things . Don’t know if they apply to Independant Contractors though. Blackball laws their called. Any Manager Trained or Schooled on such Laws will tell you it’s a very serious thing. Opens Company up to an almost certain lawsuit that they will lose. I’ve discussed it with a few Managers it’s a big well known No No.Most Companies only give dates you worked to avoid litigation. The one trick they use is new Co will ask if they would be willing to re-hire You? Answer No tells them you’re a problem. But absolutely no details otherwise. Sac fills that need for Trucking. I’d stay away from any Dac reporting Companies. If all would it would disappear. Talk to a Lawyer as Each State has different Precedent guidelines for O/O. IMO They deserve to be sued. If they didn’t fire you for whatever they have no right to try to destroy your future. Depends on facts proof and the law. Easy to say hard to do. Worth checking into Seriously they may be breaking the Law- One taken very seriously by the Courts. Big No No. The fact they have no clue shows Unprofessional/ Ignorance
caracelles, brysol01 and AlexanderK Thank this. -
I don't even think you have to get an attorney, or a lawyer. The Department of Labor here handles those kinds of issues. You should have one in your state, Oregon? These are federal laws they're breaking. You just go in and file a complaint with the Department of Labor against the company and tell them what is happening. They have attorneys who will fight it on your behalf, and they will certainly issue a cease-and-desist order on your behalf. I would get an Attorney only if you want to sue for damages. But of course this costs you up front. Good luck!

My gut says there is two sides to this story. And who the hell has 7 accidents in 3 years? You act like bending wheels, ruining tires, swiping trucks is the norm. I’d have fired you if not after the first bent wheel, but 100% the second.
What did you do the the truck? What kind of shape was it returned in?whoopNride Thanks this.
