owner operator in desperate need of help

    If you are unwilling to be a company driver, then you are not willing to do everything in your power to take care of your family. Dont let pride get in the way. If my truck went down an I was in your situation, I would take any job I could to keep my daughter clothed and fed, even if it meant losing my dream. Time to look in the mirror and have a heart to heart with yourself. Let the truck go, your credit is terrible anyway. Get a company job and put food on the table. Maybe try again down the road when times are better for you. Be realistic.

    If the company you are leased to dispatches loads to you... there is your collateral.. contract loads from them to pay off the loan.
    They pay you based on what you produce, therefore they are holding the money and can deduct from each load what you both agree to.

    You both can sit down and write up an agreement that both parties sign. They too can place a lien on your truck as collateral.
    They can work with your bank, any bank, or the loan company to guarantee that you will have work to repay a loan.
    Work out some sort of Load Factoring advance.

    2 or 3 coast to coast runs should cover the repair if you are getting a decent percentage. ... Hope you aren't hooked on one of those paid by mileage scams.
    If so, you may want to look for another company.

    Personally I'd see what I could work out with the shop, broker and the bank.
    The shop needs to do a little fat trimming off that bill.
    They can't take possession of your truck under a mechanic's lien while there is an outstanding loan on it, unless they pay it off themselves.
    So they should work with you if they want to get paid... something is better than nothing.

    Not true on the mechanic lean they can hold any vehicle tell bill is paid if bank wants it they pay the shop bill to get truck but the better question is why do you have so many loans out if you have so many bills why would you risk buying a truck but if u ask the shop and have some money u might be able to get used rear end from junk yard but the shop will not want to do the calling around on that with out marking up the part might be worth a few calls to see what u can get a used rear end for

    I meant take possession as in Own the truck for resale.
    I know they can hold the truck until the bill is paid, but I think the banks have more clout and they did not authorize any repairs so that would trump the shop since the owner operator is not the rightful owner until it is paid off.
    Laws vary by state... just food for thought to use as a bargaining chip if the laws are in favor of the bank.

    The truck driver makes repair ok and bill must be paid before truck leaves yes can not sell truck tell bill not paid for a year but after year it belongs to the shop and shop will get abandoned title to the truck I have never held truck that long but have had shop bills with storage paid by the bank when they repo it usually only takes 3-4 weeks for bank to call shop on it after u start mechanic lean paper with court

    Look in TRUCK TRADER,there are 2 or 3 lenders that advertise they make loans to less than perfect credit.

    Only 34 of the 50 states have laws regarding automobile mechanics liens. So, in some states, mechanics remain unprotected if a customer decides not to pay his bill.

    Furthermore, in my state you are not allowed to repair a vehicle without written authorization from the customer.
    Otherwise they can come in and say that they did not authorize any repairs and can legally take their vehicle without paying the shop a dime.

    Should have gotten a written estimate and been asked to sign it... if he did then he knew what the cost would be before the repairs commenced.
    If not... the shop is at fault and probably bending him over.
