We are trucking in the south Texas oilfield and have been leased on with a company, who is way behind on paying our invoices.
Does anyone know where I can read the laws about paying lease trucks?
Also, on the payments that have been made the company has taken out percentages of the invoice for billing, dot, insurance, etc. But this wasn't the agreement that was made when we leased on. Can they do that?

Do you have a written lease that explains the deductions? If you do and they are deducting more than they should you have a claim. Do you have documentation showing the work you've done ie. bol's, signed time sheets, etc. if you do you have a claim.
The first thing you should do is talk to them, find out why they haven't paid you, give them a chance to make it right. If they aren't responsive then you might have to take tham to court, if you have the docs to prove your claim.

No, there wasn't a signed lease explaining deductions.
Yes, I have all of the load tickets, invoices, driver time sheets, etc.
We have tried to contact a few different people within that company and the only one who will return my calls always says she "doesnt know".
I really think that what it all boils down to is that my husband and a part owner in the company didn't see eye to eye on some matters, and needless to say he doesn't work for them anymore!
But that shouldn't give the ability to string along payments and making up their own deductions!

go to their office and make a scene till you get paid .
walk outside their building with a big sandwich board saying that they don't pay . tell them you want the name of their bond company because you are going to file on their bond.
send them a summons to appear in small claims court .
If you want to take it even farther then find out what they drive where they live and take it from there.
If you want it bad enough tell them that they have to get a restraining order to get you to even begin to think of stopping till you get your money that you earned honestly .
so as you see you can take this whole collection thing as far as you are willing to go to get your money!

As far as the deductions, it's going to be your word against theirs since you have nothing in writing. I assume and hope you're no longer leased to them. Cut your losses and concentrate on getting paid as mentioned above.

We have nothing in writing on the deductions, which means they have nothing in writing either. So, can they still legally do that?
No, we aren't leased to them anymore. But they still owe us 10's of thousands of $$. -

That's great! It even made me smile! That might work, but their office is in the middle of no where and we live too far away anyway.
They are snakey and underhanded. When, if we ever get our money, I will make sure everyone on this website knows who I'm talking about and how they operate!
