Passenger that uses CBD, is it legal for them to bring it?

    Okay so I am a new driver and want to bring my fiancé with me. I couldn’t really find a solid answer. She uses Delta-8 and I was wondering if that would bring issues with me driving. I don’t use it but wanted to make sure I was following all rules when I hit the road.

    Probably be a big problem if a drug dog sniffs the truck.

    Yeah I didn’t know I know I personally can’t use it (not that I want to) but she uses it to sleep at night

    Same as alcohol. Can't transport it period. Even if it's legal in the state you are in, and that's no guarantee.
    § 392.4 Drugs and other substances.
    (a) No driver shall be on duty and possess, be under the influence of, or use, any of the following drugs or other substances:
    (1) Any 21 CFR 1308.11 Schedule I substance;

    To be clear THC is on the schedule one list. If you trust the label on the CBD to be THC free, well the more fool you. So yes, it's illegal to possess CDB with THC in it. And don't try the "It's not in my possession, it's my girlfriends.": Plenty of legal precedence to shows the courts don't care. If you can get to it, it's in your possession.

    Delta-8 isnt CBD, its THC. Either way bringing that into a truck would be incredibly stupid. What will happen when you crash and the cops find it?

    I have been told to try Delta-8 for some of my back pain. However, I am retired and no longer drive. It is legal in Virginia. For all the reasons @ZVar and others have mentioned I recommend keeping that **** out of your truck. Also, there is another point I want to mention. ONLY the OP can answer! Have you used this lately even just one? Be forewarned! Just one of those things can cost you your job!

    No I don’t have a use for it nor a want. She uses it and I was packing to get her and needed to know if I would get in Trouble if she had it for her own use.

    Chances are the dogs won't pick it up, but the cop will.
    If she can't sleep without it, get a new girlfriend, this is the part of cannabis that is a drug, it only should be used if you have cancer or some other problems which cause you nausea and can't eat or are in a lot of pain.
    I had prescription stuff from the pain docs a while back, it did nothing for me other than a slight cut of the pain in my leg. Right now I have nothing to help with the pain, it is always there.

    Some guys on the internet opinion won't save you from a problem. Ask your company, their rules may be much more strict than what the Feds allow. If you don't work for a company, research the regulations, call the Dept of Motor Vehicles (or whatever your state calls that office). Just liking something, like some CBD, isn't a good enough reason for me to rick my way of making a living. I found it's better to stop trying to live right on the jagged edge of the rules and step back a foot or two than it is to get involved in problems like getting fired or getting a ticket, or failing a drug test. "I love you, but I'm not willing to give up my drug for you" sound like trouble to me. You do you.
