Does anyone know the regulations for having passenger ride in the sleeper berth? In a double bunk peterbilt 389, is the harness that goes over both bunks considered ok as a seatbelt? Or do they need to have an actual seat belt like the driver?

So if both passengers are in the top and bottom beds, with the safety harness on, is that ok?

Ok I only found this, that's why I figured I should ask:
Occupant restraint. A motor vehicle manufactured on or after July 1, 1971, and equipped with a sleeper berth must be equipped with a means of preventing ejection of the occupant of the sleeper berth during deceleration of the vehicle. The restraint system must be designed, installed, and maintained to withstand a minimum total force of 6,000 pounds applied toward the front of the vehicle and parallel to the longitudinal axis of the vehicle. -
I have never heard of anyone ever getting cited for the occupant in the sleeper not being restrained. Not that it hasn't happened.

I drove a double bunk 388 (it's a short hood 389) for some time and the harness only covers the bottom bunk. It doesn't provide security for the top bunk (IIRC there is a sticker on the top bunk that says you cannot be in it while the truck is in motion).

And there is a maximum occupancy of 10 people in the sleeper. 5 in the lower and 5 in the upper.
