Hi I just worked for a owner operator and gave him 3 weeks notice before quitting but have yet to see any pay from them weeks. Is there any legal action I can take? The guy is having financial difficulty and never should have been a owner operator but I did my job and just need my pay now. Thanks.

I feel your pain.....I leased on to a 5 truck company in '07. The owner had someone operating it and this "operator" had 100% control of everything. Said "operator" screwed me out of $6800. Partially my fault for letting her get ahead of me plus cutoff pay dates were Fridays and I was in the yard every Saturday. Moral of the story, be very wary of working for people you don't know.

You can forget the Labor Board, waste of time. The best option is haul him into small claims court.

I would have a lawyer draw up a letter of intent. It might cost you $40. It's a nice letter that says pay up by XX/XX/XX or be sued. When they see a lawyer letterhead they usually take you are serious and that you won't just go away. It's worked for me after chasing a guy 2 months.

I've had good luck with the Michigan labor board. They got me everything owed.
