Pending public drunkeness, need advice...

    How is the company going to find about a pending civil charge?
    If not found guilty yet then there is nothing on his background check.
    It is not a driving violation, so will not show on annual review.

    I know I have seen plenty of signs posted at truckstops, convenience stores, hotels, restaurants, and other businesses in general that say alcohol consumption is prohibited on these premises or something to that effect. They will sell it to you but they don't want you drinking it in their parking lot. Maybe that is why you woulda had trouble with the law there anyway even without being a traffic hazard or possible speed bump when you passed out on the pavement. Lol!

    Id say these are some pretty minor charges (not a lawyer). They probably only charged you at all so they could have you spend the night in the drunk tank for your own well being. Sounds like whoever called it in was only worried about your own welfare. So, I’m assuming, start to finish it was all only about your safety.

    Cops usually know how to write things up wether they think you are a menace to society. No violence or even belligerence and they probably gave the lightest charges possible to get you off the street into a ‘safe’ place.

    Like you said, they could have wrote it up as possibly DUI or easily could have been disorderly conduct. Id think any decent lawyer could get these charges dismissed. Maybe with some agreement to take a class.

    Pennsylvania is a commonwealth tho so they have some strange laws so make sure your lawyer is from PA and wants to get it dismissed.

    Id ask the lawyer about if a background check will disclose what information about the charge.

    Having grown up in PA and having two Summary offenses. I don’t even worry about them, never asked about them never told any employer as 99% of the applications say have you ever been convicted of a Felony and very few ask for more. I have passed more background checks than I can count and was not asked once about those charges.

    Alcohol-related blackouts are gaps in a person’s memory for events that occurred while they were intoxicated. These gaps happen when a person drinks enough alcohol to temporarily block the transfer of memories from short-term to long-term storage—known as memory consolidation—in a brain area called the hippocampus."

    If a person remembers, it is not a blackout, just really wasted.

    My first was at age 15. I was with a couple of buddies on a Saturday night. We each had some beers and blackberry brandy. In those days pinball was 3 games for a quarter. I remember the first 2 balls (out of 5) of the first game. When I came to I was playing that 3rd ball of the last game. I asked my buddies what happened to the 2nd game. They said I'd played it. Had I been alone I wouldn't have known what happened.

    This is one of many until I quit all drugs and alcohol at age 30. Now, there have been no gaps in my memory, except for the ones that occur when my wife tells me something.

    First thing you need to do is get help and quit drinking. If you were one of my drivers and realized your mistake and were taking actions to never do it again, I would let it slide. Otherwise you are a ticking time bomb.
