Percentage of Load Pay

    Good Morning everyone,
    I posted last week about a crook (Johnny Jameson) that doesn't pay his bills.
    We have now gotten a lawyer to try to get paid something for the 6 loads (5,700 miles) that my hubby ran over the past 23 days.

    He was suppose to pay 25% of the load. It was my understanding that the 25% was on the gross not after his truck expenses. Was I wrong in my assumption? If he pays us after expenses it ends up at .11 cents per mile. If we go by gross its .35 cents, which in my mind makes more sense.

    We just need to prove that assuming 25% of gross was reasonable. Anyone have any opinions?

    This guy has burnt so many bridges that he can't find a driver to come get his truck out of my driveway :(
    He told my hubby that he found a secure yard to park the truck and asked him to take it there - only 9 miles away - no big deal. Just before hubby leaves he calls the storage place and finds out that we are responsible for the storage bills if Mr. Jameson doesn't pay them - HAHAHA ... so the truck still sits in my driveway.

    That guy is a crook and will not last long. 25 is good BEFORE expenses and not with cheap freight. That is how I paid my drivers. Hope it works out. You could always try to get the truck as part of the deal.

    TOTALLY ... Possession is 9/10th of the law. I'd hold it for payment. Either he will pay up or he will give away a crappy truck ... Not likely!!!

    Unfortunately he just keeps changing his company name and hires a whole bunch of new drivers :(
    We found out that he has 2 other drivers that he hasn't paid and they walked away from their loads. My hubby couldn't walk away from his because he felt bad for the customer ... At least his last load dropped 45 minutes from home.

    Hold the truck !!! Sorry to hear of the issue ... That's very poor. I wouldn't treat an enemy that way let alone an employee. I have one word for you ... Karma!!!

    Keep the truck until he pays you. Lawyer up and contact a local newspaper/tv news program to tell them how much of a crook he is.

    File a lien against the truck with your county and then start repossession proceedings against him. He will either pay or you will gain title to the truck. Either way, you win.

    impound the truck. lock it and make sure it cannot be moved.
    25% of gross is normal.

    Sounds like Johnny Jameson is going to get a spanking. I'm going to get a chair, get my popcorn and get ready to watch the fireworks !!!! Keep us updated ... I love to see the underdog win!!!
