OK ... I need some advice from you guys(or gals) who have been in this business longer than we have.
We are still trying to get this truck back to its owner. He texted 2 days ago and said he paid a storage place and we needed to drop the truck off. Found out that there was no payment made, we were expected to pay the storage lot fees AND we had to sign the paperwork so if the bill didn't get paid we were responsible. The hubby told the storage place "No Way" and told them to call Johnny and work things out to where we had no liability and he would gladly drop off the truck.
Get a text from the idiot last night. He threatens to report the truck stolen on hubby's MVR. He says DOT rules state that we have 10 days to return the truck to him (at our expense) or we could be arrested. Does anyone know if this is true?
He did pay 1/3 of what he owes my husband but still owes him about $1,400 which I really never expect to see. The truck is currently 1,500 miles from where we picked it up and completely out of fuel.
In a normal situation I know the driver is responsible for returning the truck but at what point does that not apply. It would cost us fuel to Texas and a way to get hubby back home. Quite honestly after working for 23 days and being paid $700 we don't have a spare $1000+ to get this truck back.
My husband leaves on Sunday for a new job and I don't want to deal with this idiot while he's on the road.

You can pay for fuel using HIS fuel card. If not, tell him to pay for the fuel and ride home. If not, tell him to come get his truck. Ask OOIDA what to do. They may help. It is the drivers responsibility, but I don't think you have to pay for the fuel. If the truck is bobtail, figure around 8mpg, meaning you only need a 188 gallons. So if you would have to pay, only fill enough to get there.
And you can always mess with the equipment when you return it. -
I'd leave the truck at the storage place and walk away without signing anything. They'll send a nice bill to the owner of the truck.

One thing you can do and will work is drive the truck a few hundred miles, park it in a truck stop and tell him it broke down. Then, you can do a few things with that. One tell him to get it himself because it is broken, or two tell him the truck is broken and it needs x amount of money for it to work.

Is the truck even legal maitence wise to be driven on the road?

bring the fmcsa down on him....

Did he bring the truck to when you hired on ?
If not and you went to him to get then man the heck up and take it back to him !!
Right now you are no better than he is in this little game you are playing with him .
Stop trying to get out of doing what is right and just do it .
Look at this a well learned lesson and don't look back .
The world is full of scum don't make yourself out be scum too by acting as bad as he is .
Like momma used to say two wrongs don't make a right.
You could have had all this over and done with by now if you would of just acted in honorable way.
Doing what is right isn't always what is easiest .
The way it is going to end up is you are going to loose even more than you would have if you just would have returned the mans truck to him and been done with it .
You got screwed and it sucks been there done that but you are just making it worse by stooping to his level .
Next time you go to work for that small of an outfit make sure it is closer to home so you don't loose even more after the initial loss .
Before everyone gets their panties in a wad I know it sucks and it cost money and time but right is right and being as slimy as the slug that screwed you doesn't make you any better than him .
So let the flaming begin because I wont sugar coat it and make the OP feel all warm and fuzzy . -
One word ..... Idiot
why in the hell would I spend the money to get the truck back to him?
he didn't even have enough gas money to get the last load dropped off ... -
Second it is true you are beginning to look that way.
The reason you should want to get him his truck back is because it is the right thing to do .
I am seeing though that you don't care about right and wrong unless it is happening to you .
You are very mad right now and rightfully so .
But once again just because he is acting like a fool doesn't mean it is ok for you to act like one too .
Just because you were wronged does not make it right for you to turn around and do wrong .
