Perplexed by forced per diem option?

    Write Obama! He wants every frikken penny he can spend! I am thinking I am going to turn in a company I briefly worked for. They were paying perdium on in state home every day runs. AFAIK the IRS will pay the whistle blower a percentage of the money recovered.

    Bottom line, per diem needs to be done away with altogether.

    However, a lot of the drivers wages could be reduced. If the truck driver was promised 39 cents a mile, and 12 cents of it was coming from per diem, what are the chances of the trucking company of replacing that 12 cents per mile with regular income?

    The driver will end up only receiving 27 cents a mile.

    12 cents a mile x 100,000 plus miles = $12,000 plus in lost income for that year.

    This needs to be gone over CAREFULLY, before any mistakes are made.

    You would still make the .39 per mile, they just wouldnt be able to take out the .12 and then give it back as per diem. Let us worry about itemizing not them trying to do some of it for us.

    but MJE does have a point, if 12 cents is per diem now, which means the company is NOT paying the matching taxes on that almost third of the pay, then if the per diem is not given, the company may NOT be willing to pay 39 cents per mile since it's tax liability has increased.

    JBHunt put me at my regular pay which was 39 cents to begin with after i told them stop the per diem of which i opted out of to begin with.you dont fight for your rights you will never get them.

    If the IRS audit turns sour, and I lose the appeal on the tax home issue, I will become an employee of my wife. I will take the per diem at the paycheck.

    thanks, that was actually quite helpful in my decision for this year. i work for a company that does Not offer per diem of Any kind no matter weather we are away from home or not. Essentially the division i work is regional and i under most cases return the same night (unless i run out of hours by getting screwed at a customer) or something, yea like that never happens in this industry...lol on Many occasions i have to be at my customer several hours away Bright and early so i choose to leave out the night before and sleep in the truck anyway so i do not have to wake up before 3am and try staying awake to drive several hours. the last few years i wrote off the 80% of $52-59 or whatever it was at the time anyway...still wrote it off and was never questioned about it and i had received a decent refund (not nearly enough but acceptable) i do not have the patience to actually keep track of what days i stay in the truck overnight...btw i have also always written my entire cell phone bill off for many years without raising any "red flags".....Yet....when filing my taxes next week for last year i intend on only taking a meal deduction for "75 nights". it will draw less attention...
