Perplexed by forced per diem option?

    Yes they do driver...... down in the bottom of the blue collar world where immigrants and day laborers hang out and in some lesser industries ......

    Instead of a check you are issued a check card much like a Mastercard. Your pay is on that card.

    The kick is when you draw money off the card, there is a charge, like an ATM fee , like 1 pct. You just paid to get paid.

    I finally got my W-2 last week and went over the previous years tax return in the process of doing my taxes.

    The perdiem is not mentioned anywhere on the W-2. Looking at my paystubs and doing the math, the company claimed 47% of my income as perdiem. That's outright criminal and I bet more companies are doing it. The IRS doesn't have a clue how much they are hiding.

    You will be responsible for the penalties and interest. They are hosing their worker comp insurance company too.

    Just how?

    If they are doing the per diem incorrectly, then, they are the ones in error.

    I am talking about the w-2 incorrect.

    Rug is right. I'm sure drivers are double dipping and doing perdiem a second time on what's showed on the W-2 like nothing ever happened. To tell on the company might come back and haunt the drivers after the dust settled.

    As much as I would love to report them, I don't want to get any drivers in trouble.

    No doubt on that part.

    If the company is showing that high of the per diem, their records are in question and the IRS would only find it if they audit the firm.

    Most of the time, the reason the IRS finds such items is through contact with employees who have questioned the action of the company through contact with the IRS.

    Landscaping company I worked for the boss showed on the check stub he was taking out SS Med and income taxes. He was really using it to try and keep the company afloat. They came after the employees not the employer.

    It is your responsibilty to see it gets paid. The staffing company I am working for is paying me perdium when I am home every night, and sometimes don't leave the state. They lied and said "Ceva pays it that way" Bull cookies! I saw their bid sheet for their company drivers. No perdium mentioned. They are hosing me and their worker comp, and my social security.

    Must have been a screwy deal.

    I had several clients back in the days that withheld the money from the wages, but did not send the money to the government.

    This is a violation of the law, since they withhold the money in trust for the governments.

    The employees filed the tax returns and received their refunds or whatever. The IRS sent them notifications and all they had to do was show proof of the pay stubs and the IRS nailed the owner.

    This has always been the way IRS runs.

    Maybe your situation was where they ended up being 1099.
