The exposure to lawsuit is still there because we are essentially controlled on all we do except the speed and where and when we go.
I'm sure they're hoping to mitigate some exposure however a jury could easily see thru their veiled attempt at relinquishing control to the IC.
No other contractor they use whether it be maintenance, cleaning, IT, supplies or whatever have to adhere to the ridiculous policies we do as drivers.Home_on_wheels, flatbedder4life and PoleCrusher Thank this. -

Hold on. So what your really saying is I'm a company driver and just to dumb to realize it. And in your words % and mileage are the same but once again I'm stupid? Please explain yourself. How in the world could you equate the cleaning help to this discussion. Good lord man. Im starting to think you are drinking to many of your wife's shandy's.

Where on the load board do you see any load that shows 65% we assume the total revenue is 65% but we're taking SNI word for it. I'm not bashing it because I know this and accept it however all the loads have a estimated miles loaded and a line haul rate with an estimated rate per mile.
We all figure our rate per mile all miles included to determine if we want to book it. In reality the only place we ever see 65% is in the schedule of fees in the contract and in their advertisements.
I'm not saying it bad but the reality is we are on a sliding mileage scale where we book our own loads.
FW just left Cali and said he wouldn't leave for less than 1.40 per mile. If it's not a sliding mileage scale then I don't know what else it could be.

As for the cleaning help it's contracted out..ie. independent contractor to do the cleaning however they don't do SNI mandatory training or recert etc.
I don't mean to make it sound as if your stupid, that's not my intent I was just saying we're not as independent as we sometimes think. -
I did say they got rid legacy because of greed that's why they forced all the legacy drivers onto the choice board. Or they left SNI.
I ran on the Legacy program a few years back and I did really well as a Husband wife team then when my wife quit driving to raise our newborn daughter I went company. I only came to choice so I could make sure I was home weekly.
Legacy paid all dispatched miles, detention after 2 hrs paid to go mt hunting. Not as bad as those who never ran it made it out to be. If they started a mileage program tomorrow with the same pay structure as the old legacy BUT the driver could pick their own freight I'd sign up. -
I get what your saying. And I appreciate it. I have always thought it's a great program. It's just not for some. Just a little bitter about you not sending me my six pack of Mason jars and candles I guess. I do love a good disagreement. Just me.

One more thought to ponder!
As an Independent Contractor in every other field I know about the contractor and Independent contractor negotiate terms of the agreement.
What terms have we ever been able to negotiate?
