Picking up fresh eggs tomorrow... Ag exempt?

    Maybe the boss doesn't want you to run ag-exempt because the time for you to get there will be quicker. Might be the shipper or receiver watches for this and will expect everyone to arrive quicker. The boss might be aware of the exemption and wants to have the luxury of using it in case of a breakdown.

    Sounds odd not to run the way the boss asks.

    Recording the Agriculture Commodity Exemption on the ELD

    When operating within the 150 air-mile radius the driver can either identify the movement of the commercial motor vehicle as authorized personal use on the ELD or refrain from logging into the ELD.


    • If the driver logs into the ELD and identifies the movement as authorized personal use, then the driver must also make an annotation on the ELD explaining that the movement is exempt per the agriculture exemption. Upon exiting the 150-air mile radius the driver must allow the ELD to record the movement of the vehicle as on duty driving.

    • If the driver does not log into the ELD while operating within the 150 air-mile radius then upon exiting the 150 air-mile radius, the driver must then log into the ELD, identify the movement as on duty driving, and make an annotation on the ELD explaining that the unassigned miles accumulated prior to that point were exempt miles. For example, the driver was transporting soybeans within a 150 air-mile radius of the “source” of the soybeans, from the time logging into the ELD at 07:34 a.m. until exiting the 150-mile radius at 10:15 a.m. An identification of the source as well as location of exiting the exempt area in geographical terms would also be of assistance. The driver has the burden of proof to show that he/she was legally authorized to claim the agricultural exemption.

    That pretty much covers it. Its really not that hard to understand. I have an app that would show a circle, centered whereever I wanted it, on a map. I would center the circle on the shipper set it to 150 mile radius so I could figure out exactly where I could start and stop using Ag Exempt. Sometimes it made 1000 mile days possible... My best day was 992 miles.

    My best consectutive 14 days was 7600 miles... Idaho to the mid west and back twice in 14 consecutive days. But that didnt happen very often, the sun, moon, and stars had to align just perfect to make that possible.

    Its not about the 300 miles... Its about the ability to take a 1600 mile run from a 3 day run to a 2 day run. Or a 2300 mile run from a 4 day run to a 3 day run.

    So pulling a reefer with a load of fresh eggs he just shows up a day early at some wonderful grocery receiver and they say, wow driver great job! so happy to see you a day early go to door #!... and we'll get right on it! Hahahaha!!! Remember what his company said, run it per ELD regs. In all likelihood the stars did not align on this load and he violated company policy

    No... Not generally. These things need to be scheduled. But often times I would reschedule my own appointments if I knew I could make it there earlier. I didnt rely on someone else to do the work for me, I took initiative and did it myself.

    That doesn't always work either. They don't necessarily want it a day early amd not always going to accommodate. But yeah if somebody thinks going against company policy to run exempt is worth it on one load they should knock themselves out.

    Yes you can, off duty PC with a note that you’re running under the MAP21 ag exemption.

    And it’s not just 300 miles, like I said if you work it right you can use up your ag exemption to fulfill your 10 hour break requirement.

    No you can't. Company policy supercedes federal regs if it is more strict than the regulation. If he is independent he can run it on the exemption but he can't do that as a leased operator or company driver when the company says otherwise.

    Let’s just say for poops and grins he was loading in Mankato. Once he hits the edge of that circle going in he can run PC on his log, or if he’s unloading somewhere within the radius he won’t have to go on duty at all once unloaded. Then once he’s loaded he wouldn’t have to start his log until Ames IA it looks like. For fun let’s say he emptied out in LaCrosse WI. He could get empty and run a couple hours up the road, grab a bite to eat and a shower, maybe nap a couple hours, run over to Mankato and load, then run a few hours down the road and nap again or something. The main thing about the exemption is not having to log a single thing within that radius. No drive time limit, no 14 hour limit, when used properly it just makes things easier. It also saves hours on your 70 too.
