Picky, picky, picky! Have carriers ever been this picky?

    Don't get me wrong. I agree points for an infraction in a CMV should count more than for a personal vehicle. Also, the type of infraction should count differently. Heaven knows, I've deserved tickets, I've never gotten.
    But it is what it is and we have to adjust.
    For the better, as far as I'm concerned, means we get some of these hot doggers off the road and a better driver in the CMVs.

    FMCSA/DOT barred the public from viewing the AccidentSEA because it was believed to be misleading for the same reason, i.e., no assignment of fault, but still assessed against the carrier. ( http://ai.fmcsa.dot.gov/SafeStat/Removal_SafeStat_Explain.asp ) The same problem holds true today with CSA 2010. The Crash Indicator BASIC is similar to the AccidentSEA, particularly in that a crash, even with fault not determined, goes against the carrier.( http://csa2010.fmcsa.dot.gov/FAQs.aspx?role=MC , Question 100)It seems a bit odd that in the 6-7 years that CSA 2010 has been in the works that this obvious flaw has not been sorted out. I'd be willing to bet, though, that FMCSA/DOT will be able to build strong enough cases against carriers even without the Crash Indicator.
    Just a hunch!

    Last October in Austin, TX I was hit by a lady cab driver....

    She originally stated in the Police report she wasn't hurt...
    Two weeks later she filed a lawsuit against me....She claimed she was hurt and could never work again....
    It took almost 6 months for it settle out of court.....

    So after the insurance companies settled..they agreed to assign 70% of the blame to her and 30% to me...

    My 30% was due to me "Failing to control my trailer and maintain lane control while engaging a curve".

    She hit me because she tried to get between me and the curb to pass me on the right.....

    You drive long enough you'll see everything......:biggrin_2554:

    Now if you look up my Safe-Stat...You'll see under accidents..."Towaway".....Eventhough it wasn't my fault...It was a "Non-preventable"....

    That will go on my CSA 2010 as points.....CSA 2010 doesn't have exceptions for "Non-preventable"....An accident is an accident...and that's all DOT sees......


    Last Friday...While heading south from SLC....A kid drifted from his lane to mine and nailed my right steer and crushed his driver's side door....
    I had witness to back me up that he was texting.........

    I guarantee this will go to a lawsuit as well....
    People don't see company logos...They see $$$$ signs....

    DOT sees Points......

    You have 0 experience and under the current CSA 2010 system....You have a clean slate....

    This is part of the reason for the delay......It was to have been in effect right now....
    It has been delayed until November according to my last email from the FMCSA notification email I received last week.

    There are many veteran drivers who have a million or more miles with zero "preventables"....But they would currently have points for even for "Non-preventables"....Under what would have been CSA 2010....

    Oh...and that parking lot accident scenario....
    Your typical LEO response would be: "Driver....You shouldn't have been parked there...You are a 'Profesional'...You should have known better...."....
