Please help! Broker won’t pay and wants me to pay customers labor costs

    I agree that the rate con needs to be read completely for the stipulations pertaining to this type of condition. They might just be trying to get one over on you because they're angry, which to a point they have good reason to be, but to take all your money I don't think so. You might have to just put this one in the loss column, although I would never pay them a dime. Stuff happens, for lack of a better word.

    The minute yelling begins is the minute you hang up. Wait 5 minutes and call back. Keep your composure, try to be the professional, even though you had alot of explaining to do on this one. Book your next load, and then the next, get this one out of your head, just see how it plays out.

    Yea, it took my years to learn that losing is a step by step process.

    I'm curious about the unloading crew. was this flatbed where they needed a crane to unload. if so that would have a big effect on getting a bill

    Sorry op, had to break this down.

    Excepted a load got four hours from destinations and truck refused to start it was freezing Anda because the truck would not start there was no heat I had my animals with me and my wife and we ended up cuddling togethe for warmth

    we periodically attempted to repair the truck this went on from 2 o’clock in the morning until almost noon the next day my appointment

    To be unloaded was at 6 AM and I missed it I couldn’t get cell reception where I broke down I had to walk a ways down the road to get a signal and when I did so to be able to call a mechanic ,

    I got text messages from my broker and phone calls and text messages from the actual customer and phone calls wanting to know where their freight was so I immediately called I let the broker know what had happened and the man was very unforgiving and continued to threaten to call the authorities as if I stole the freight.

    once I got the truck started by luck I called both the broker and the customer immediately and let them know I was on my way it was noon and they closed at 5:30 so the broker said well we may have to do it tomorrow if that’ll be OK so I began to make my way towards the destination and


    I stopped for gas and was so exhausted from trying to repair of the truck all night I decided to Rest for a minute and ended up falling asleep once I woke up I made my way to the destination it was after 530 so neither the broker nor the customer were answering their phones but the minute the morning came my phone was flooded with threats that the authorities had my MC number and acting as if I stole their freight I called them and let them know that I was in front of their building ready to be unloaded and they informed me that I was not to move from that spot and I was going to have to wait until noon for the crew that’s unloading my cargo to return , I did that

    I waited and 1 o’clock rolled around and the crew arrived and the customer was upset he was very short and just was very angry and it showed with the way that he spoke to me and the way he gave me the instructions to be unloaded and once I was unloaded I went to get my BOL signed and the customer came with a cell phone in his hand and pointed at it yelling that this is a cell phone and this is how you use it and I cost him how do you use it and telling me that I cost him

    however much the labor it cost for those guys to be there andI explain to him what had happened my car not starting and it being below freezing and leaving more worried about freezing than getting his car go to him at the moment but as soon as I was able to

    I did communicate with the broker and the broker just didn’t communicate with him and he seemed like he understood shook my hand and sign the BOL and I turned it into my factoring company and they said the broker is refusing to pay it because the shippers is me the carrier is responsible for paying for the labor and the rental cost of the equipment there saying that I owe them $1300 for being

    just a little bit late but I have to pay them I don’t see how that’s right I don’t know what to do what do I do please help I paid for the gas to get that freight there’s lost my time because I had to sit there an extra seven hours I lost a day and I didn’t get paid , is that legal Also just a sidenote I was reading over my contract with the broker and he has a clause in his contract that states that the carrier is to pay any detention time to the broker I didn’t think that makes sense that’s not a thing is it why would a terrier pay the broker for detention time?


    Ok first thing is do not ever stand being yelled at. Never!

    walk away, get back into the truck and ignore it.

    that said, there should be a rate con or a brokers contract. You have to read it and see what it says, if it doesn’t say a thing about being late, don’t sweat about the late part, just don’t use the broker again. The labor is on the customer, if it isn’t in the rate con, it is not your problem, he would have to sue you, which brings me up to the broker, file against his bond as soon as you legally can. Screw him, his job is to talk to the customer, not you, he failed, not your problem.
