    Our Safety Dept sent out a memo regarding the points and some general infor that will be in effect. You will see "DHE" mentioned concerning logs and safety forms, just mentally put your companies name in place of this. I thought this would be good to see for everyone:

    I'm betting most safety departments will make drivers with points aware of where they stand .

    I am the Safety Dept! lol However, I am fairly new to the company. I read your reply in another post that the only states that have scores available will be the test states. But still where so I find the scores when they are available? I know we have drivers that are going to be in hot water with logs. I have just started checking logs and had to fire 2 people already. Totally non compliant, totally wrong where they said they were etc... for 20 days in a row. This company never checked logs!!!!!! Now I am really worried about the rules and regulations and ow they are going to check things in the past. It says that the record is going to go back 24 months. I really need to find where to find the info so I can make corrective changes.

    They are going to check violations for the past 2 years . You only need to keep logs for 6 months but most companies keep them longer for tax purposes . Even if you fire employees you have to keep their records for six months . If you are audited during that time and the violations will be charged against the company . Criminal charges can be filed for allowing a driver to violate HOS .

    So basically what you are saying is:

    When you are pulled over for a roadside inspection, if you are given points at that time they will go on your record and the record of your employer (The new points will be x3)

    If you are audited, then any violations found will go on your record (if you are a driver and have log book violations) and also it will go on the employer.

    That is the only way that anything will be on your record? Plus anything that is on record for the previous 36 months. With points either being x1 or x2 depending on how far back they go.

    And also from what I am gathering, you will get a letter when points are getting to the critical stage for any driver. The driver are allowed 90 points before they are unable to drive and a carrier has 72 points?

    And that there will be a website stating what each driver has for points and that they can get the points by paying a $10.00 fee?

    Am I missing anything?

    A key point in the group is the fact that the driver doesn't even need to get a citation. There is a specific inspection form with CSA 2010, that will note even (what used to be "fix-it" categories) lights, tires, log not showing the morning pre-trip, and the like.

    Also, a driver can no longer "milk the truck" to a repair facility to get a flat repaired/replaced...the drivers now must stop at the closest "safe point" and summon road service to repair/replace the flat...big points on running with a flat...oh yes this includes an under-inflated tire, so everyone needs to have a pressure guage and the long air line to be able to inflate an under-inflated tire.

    So another case of drivers get the big screw(ball) and the road service groups (T/A, Less Schwab) and the likes get a perk in new business.

    Joe is operating his tractor-trailer on 1-65 in Birmingham. Although he just entered a reduced-speed zone of 60 mph, Joe is still going 65. Joe is alert, having just stopped for lunch and coffee. An enforcement officer stops Joe for a roadside inspection, noting that he felt Joe was speeding at the time.

    During the inspection, the officer found that Joe did not restart his log entry after lunch. The officer also determined that one trailer tire did not have the correct air pressure. The officer required that Joe bring the log up to the current duty status, and recommended that Joe observe the posted speed limits and add air to the trailer tire at the next truck stop. Joe did not receive a moving citation, was not placed out of service, and
    was not required to air the tire immediately.

    As a result of this roadside inspection, Joe's Driver Profile will now show three violations:
    I) Unsafe driving--- speeding
    2) Fatigue-s- a serious violation of log not current
    3) Maintenance-s- tire underinflated.
    These violations will remain on Joe's Driver Profile for 36 months.


    So based on the 4th pdf. The driver who wasn't ticketed, he will receive:

    5 pts speeding

    5 pts driver record of duty status not current

    10 pts operating a CMV while fatigued (their comments on pdf 4)

    There are no points listed for an "UNDERINFLATED" tire, which btw just how do you determine that with hot tires?

    Basically Joe won;t get a ticket, it's not a big deal for a fine...but it does go against your record.

    This makes NO sense at all. Either you are in violation and have a ticket or you don't. You cant just punish folks because you "FEEL" someway, or chicken-#### them out of a job/career.
