    In a scenario like this, if they catch the guy, won't your insurance go after their insurance? Maybe he didn't hit you, but he's definitely still at fault, isn't he? Honestly I've never been in a serious accident like that (knock on wood) and I don't really know much about the process. Seems kind of harsh that just because he didn't hijack your truck and personally run it into the ditch he gets off the hook for damages even though he created that entire situation.

    Oh insurance will likely still pay for the damages in the end. But because he swerved many will claim your not eligiable for it and fight you tooth and nail. Some have fine print that swerveing makes you entirely liable too. Doesnt help most will also as a middle finger just list you as at fault or such internally and jack your rates way up BECAUSE you swerved. Insurance be like that sadly.

    If you don't swerve, does that ever leave the door open for some billboard lawyer to make you out like the driver from duel and try to squeeze you in civil court?

    Yup and if he serves and rolls or hurts someone else. It also leaves the door open to lawsuits for that too.

    Not to mention expenses for cleanup if any fluids are spilled (diesel fuel,DEF(if equipped),motor oil,etc.).
    Hazmat cleanup for that can easily go into the seven figure range!

    When that moron ran a red and blew open the hydraulic tank, oil pan and radator on my old pete. The bill for the cleanup was $87,654....yes i looked. The cleanup cost more then my truck was worth. So trust me been there done that have the Tshirt.

    We discuss who pays and as usual, money is the bottom line on any event, BUT! the driver of the rollover truck is going to have to explain for years to come, why is this rollover on his record. Had he held his lane and head on collision or side swipe, either one of these would be much easier to explain than a rollover, especially if they never find the Cadillac and don't expect the search for the Cadillac to be very extensive
