Port of L.A. OKs plan to exclude owner-operators

On March 20, the Port of Los Angeles approved its Clean Truck Program, which will bar owner-operators from the port by 2012.

That port and the Port of Long Beach proposed matching programs, but in February, Long Beach deviated from the shared plan when it approved a provision that allowed owner-operators to continue serving the port.

While the Teamsters back the employee-only plan, it has its detractors, including the Owner-Operator Independent Driver Association and the Los Angeles Area Chamber of Commerce. The American Trucking Associations filed comments with the Federal Maritime Commission March 3, stating that the ports plan was pre-empted by federal law.

Last fall, Sean Connaughton, maritime administrator for the U.S. Department of Transportation, told both ports that the employee provision may be beyond the scope of their local authority.

Looks like what could be the beginning of a wonderful class action suit.

Sounds like an opportnity for the Ensenada truck companys to expand, or intermodal divisions of the big companys getting a percentage from o/o's in the ports. Being a Callyfornian, I'll guarantee that someone contributed big time in campaign contributions that will see 100% return on their investment.
