Pre Advice if Company does not Pay! Another Chicago Horror Story

    The lawmakers really need to look at these independent contractor agreements more closely on a nationwide basis. I actually think you can win because they violated the contract. They promised you 80/20 split on the loads which is on your contract, and my math from what you posted is more like 65/35 or 60/40. They definitely need to pay up, the question is how much is it going to cost to recoup that money.

    they were not taking out 20percent before load, they were just scamming thousands off top, depending on driver ignorance, because I had talk to one about that first load that I was told paid 4260 to be exact when in reality it paid 6500 with a signed rate con I found through brokers tracking app, but when I talked to recruiter they said ahh yes you gross 4260 so 3408 after we take our split. when it should have been 5200 my way not 3408. so they stole 2,240 of top then was gonna have nerve to take 20 percent of the supposed 4260 they told me, so another 852, so in total they make 3092. I don't care if the lawyer takes all the money again this was a blink of an eye in my life, I feel bad for the drivers that have been there or any of these places for months or years. Whether I win or not I still will probably lose, but I have to try at least. I just don't like the fact that if I walk away if gives their ego an even biggers boost, with them thinking see we can do whatever we want and steal however much we want and not pay #### to the drivers, and there are lots of drivers going to this one place everyday, not even to consider all the others that are doing the same thing. I just wish I had got more drivers #s there, so I could spread the word faster, I have all documentation, voice calls, Bols, text, everything....

    I am sorry Bryan, I don't want the feds meddling into this when it comes down to compensation, because if drivers want this, then the HOS and other things the feds meddle with will be off the table for all of us when they do something drastic. I am worried about the crap in the pending legislation that is buried deep into it, the green new deal crap. While it doesn't effect me as much as it would effect others who have older trucks, I don't see anyone getting away with their old pre-emission truck or gliders without emission engines, these are fanatics running parts of the government, not rational people who used to be there. so if they can do that, imagine what they can do with HOS unleashed.

    What I want drivers to learn about their rights, and to have a strong CDL program that includes an understanding of those rights as a requirement.

    This is where the feds can make a simple change to the CDL program and possibly force uniformed laws so everyone is on the same level.

    This is where we are failing new drivers by acting like this should be an easy way to make a buck or in other words to get a job.

    No offense to the OP but this is one thing to fight, crap owners who screw the drivers and there is no reason why we can't all be involved in getting rid of them.

    You got screwed, ain't the first and won't be the last.
    You'd end starving in line waiting to sue these sham companies.

    Find an honest employer and let your ethics guide you through the remainder of life.

    Or the IRS could do their job and enforce the current regulations and then we wouldn’t need additional laws. It’s these shady operators and guys that sign up with them thinking they’re going to play truck owner that will end up ruining it for the ones who are doing thing legally.

    Exactly, I'm not here to start anything with anyone, Not everyone here came from a trucking family, or knows business, but when most guys in this industry came into trucking they didn't know a thing including myself, had never even heard of a truck stop or Pilot...etc had know Idea what a weigh station was, its to change their life from the worst or just want a good honest paycheck and know they don't have to worry about being screwed, its sad, and its not just the Chicago companies because I know drivers I trained at other companies, that they will rip you if they get the chance and drivers don't speak up. But this is ridiculous, and as I said I am hard headed, so I learn the hard way, didn't take me but a few days to uncover their scam, but now just on how to take this from here because, us drivers know the work we put in on the road, and the sacrifices a lot to put up with, average Career Driver Life span 61yrs.

    You should have bought you a plane and started your own airline. A lot more government intervention than being a trucking O/O.

    I understand totally. I guess my mind frame was along the lines of classification. When a driver does that fleece purchase, I don't feel like they are ICs. Its different when a driver buys his own truck and leases on. Then that's different. Then they go buy whatever business model, like the one you described in one of your posts earlier. It's the BS owners that do this illegal ish that annoys me but the same time, I can't understand why drivers don't get their money right and get a reliable truck of their own, then lease on. That way the driver has more leverage.

    I would venture a guess, that a greater percentage of the drivers that try the L/P have little or no money to put down, lower credit scores, no money saved back for breakdowns, emergencies,etc. They think that they are on the way to ownership, when sadly, a lot of them turn out like this.
