    Paul Taylor the one that handled this case is the best.He was my lawyer against another company.I received a nice settlement.That was last winter.I received a copy of the settlement agreement today.Paul knows the laws inside and out.

    Sure you can, but did he deserve what he got? He drove his tractor home. The problem is that he made it unusable to the company according to his contract. If he had driven it to the terminal, and then proceeded home, he wouldn't have had the abandonment beef on his DAC report.

    What happens when any of you become unfit to drive your truck? Do you just take it wherever and park? NO... you follow the procedures your carrier sets out, which means you take it back to the terminal they tell you. Otherwise expect to be accused of abandonment.

    A Model on stupidity; The Carrier submitted False information. i.e. conjunction, conjunction, whats your function, hooking up words, phrases and clauses. Like peas and rice. Hey, that's nice.

    don't know the law, not about to read the link

    but

    if my company informs me that I am unfit to drive their truck, I would think that they would not want me to then drive it hundreds of miles to a terminal.

    I think it would be an interesting series of QUALCOMM messages at that point ;)

    I think OSHA got this one right IP. He was given permission to go home by his fm then wasnt able to legally drive once there. Thats not abandonment. I like Prime and I liked Maverick but all companies I have worked for have been guilty of doing this. They get away with it because they are rarely challenged. Im under no illusion that even though Prime treats me well that that wouldnt change when it benefitted them.
