I would like to see the results of the toxicology screen on the deceased man.

I'd also like to know how fast he was traveling, and what the speed limit was on that road.

    201 and drvrtech77 Thank this.

The driver coming onto the highway is supposed to yield to other traffic, not the other way around. The Publix driver for whatever reason didn't see them coming, or worse, didn't care. It doesn't matter much if the other driver was intoxicated or not. The speed limit I think is 40. I don't think they were driving so fast that the trucker couldn't have possibly seen them, especially with those bright headlights and nothing in the way. I don't think there should be a nuclear verdict or anything, since I doubt the driver who died was even paying attention. But this absolutely could've been prevented by the Publix driver.

If they wanted to charge the dead person with DUI, speeding, or whatever, that's fine with me. But that doesn't change the fact that the trucker should also be held accountable.

Oh, don't you worry, this will slog on for years. I'm sure the Publix driver will get nailed, and fired, but in their defense, it was probably hard to determine the speed of the pickup, and had the pickup driver been coherent, it may not have happened at all. I would think if that was in front of the DC, and used regularly by trucks, shouldn't there be a stoplight? Not that it would have mattered anyway.
