Putting a load into storage

    I'm under a load and I need the broker to reschedule my appointment. The shipper was so late loading me I left the shipper after my appointment time. I had been in constant contact with the brokerage during that time and I could not get them to get back to me to tell me what was happening with the appointment until I was almost at the receiver and they just told me to deliver it. They did not give me any appointment time.

    When I reach the receiver they told me they had way too many trucks they were completely jammed up and they told me to come back. So I left and I took a nap and I came back. When I returned back to the receiver they told me I missed my appointment time by half an hour. I told them well you told me to leave and no one told me I even had an appointment , so I thought you were working me in. They said no the appointment has to be rescheduled by the broker.

    So at 3 a.m. I called The Brokerage. They tell me someone is here and they will start working on it. It is now 10:16 in the morning. I called again and the person tells me oh I'll get someone started working on that. Nobody knows what's going on because nobody's going to do anything about this. This brokerage will pay you on time and all of that as long as the load goes smoothly. Any problems and no one seems to ever be able to get a hold of any of the brokers.

    So I sent the carrier representative and the person and team that is supposedly in charge of this load an email and I told them I am going to get up I'm going to have breakfast I'm going to rest a little longer and when I'm done I'm taking this load home with me. If they cannot reschedule it for early Monday I'm going to take this load and put it into storage and I will deliver it at my convenience because I will keep working. I also told them I have made every effort to resolve this I have called multiple times I have emailed multiple times without any response at all indicating when this load will come off of my truck so I have no choice but to do this.

    So my questions are as follows:

    1) how do I find a facility to take this load?
    2) I assume I am not legally supposed to do this so I guess that means whatever the storage costs I will eat it?
    3) is there anything legally they can try to do to me?
    4) what are the odds that I actually get paid from this load?

    At least this one is an interstate load and if I need to I can go after their bond.

    Anyone with any advice having been through similar situations I'd be interested to hear.

    This definitely is a situation where having more then 1 trailer is ideal.

    I’m sure I know what state your in, but if you happen to be in my state then let me know and I’ll cross dock it for free.

    I probably would have left the shipper before getting loaded, or had them stop loading and remove the product if you were already past the delivery appointment.

    Storing the product will cost you at least $500 and who knows if you can trust them.

    Id either go home and wait until the new appointment, have them change it to a drop trailer, drop it and go home, or go back to the shipper and get unloaded.

    For the sake of information and curiosity what is the product? If they refuse the product do you store it? Hold it till payment? Release it and reload to another trailer? Money upfront? If pulling it off and reloading it were that simple.

    Well they suddenly answered me when I told them I was going to put it in storage.

    But at 3 a.m. this morning they told me they were working on this. About a half an hour ago I got an email and the guy said well I'm going to put in a request for Monday like you asked. And I said no I want to be unloaded now today! You were supposed to take care of this at 3 a.m. and here we are eight and a half hours later and you're just starting this process?

    So we'll have to see what happens but the best I'm going to do is take it back home with me but I did tell them I want them to compensate me for bringing it back here because this was their fault they didn't do this at 3 a.m.

    Not going to hold my breath on that one but the same point in time I'm not going to sit here all day and all night waiting for these idiots.

    It's a beautiful day and I have things I need to get done at home.

    Sometimes you have to take the lesser of the evils and roll on.

    It could be worse.

    It is dry food I think it's cat food or something.

    Once I have the appointment they won't refuse it. But in cases where that happens you have to call the broker and then the broker talk to the customer and then they figure out what to do with it whether you can throw it away or if it has to go back to the shipper. If it has to go back to the shipper then you renegotiate another rate for that.

    But this is why it's really important to read your agreements and rates cons because yesterday I turned down two loads from Brokers that had it on their rate con or in their agreement that the carrier agrees to haul any refusals back to the shipper either at no charge or some ridiculously insulting low charge, like maybe if you're lucky covering your costs.

    No money upfront and for the most part I've been very fortunate with payment and that type of thing.

    It is weekend, people who call shots at the receiver or brokerage may not be accessible.
    I am sure there'll be a resolution on Monday.
    Sorry @Dino soar but you are only a little nuisance to them now. They may not want to go out of their way to help you asap.
    I'd wait till Monday, not to make matters worse than nessecary.
    As far as depositing load at a 3rd party storage, it is widely practiced for partial loads where such screw ups are all too common and it is also often done with freight sent by train

    Arrangements could be even made with the 3rd party so that they would deliver the product themselves. Of course, a nessecary degree of trust must be established with the 3rd party.

    With full loads, the issue with this way of handling it, might be when the receiver is strict on arriving with the seal intact.

    It is used somewhat loosely and the most accurate would be when you have two trailers or two different types of trailers. Say it’s a container and it needs to be unloaded and reloaded onto a van. Or a van and needs put onto a lift gate. Or removed from one companies trailer and put onto another company to finish it out.

    In this case basically get it off his trailer, but it not go into long term storage either, and be picked back up somewhat soon after by himself or another company, or even my company, for delivery.

    Basically utilizing two docks and the warehouse space behind them.

    You back in a trailer, take it off and put in another trailer across the dock. Ltl does this a lot.
