Always easier to blame the big bad company instead of taking responsibility and admitting a mistake. Given two options, gets canned, worried now about finding a new job, so it must be time for a lawsuit!
If I were hiring drivers and found out an applicant was terminated for violating company policy and wasn’t available for rehire I know right where that application is going.
Q: Alleged misconduct of cell phone use? What do you think?

If you apply to another trucking company and the application or recruiters ask about past terminations you need to tell the truth. Lying on an application is almost always a firing offense. We recently had some post they were fired, quickly got another job by lying on the job app. Once the truth was known he was fired by the 2nd company.Siinman Thanks this. -
Numb and bryan21384 Thank this.

Depending on State laws, a prospective new employer has no way of finding out why you were terminated, other that public driver’s license records, or failed random drug test’s.
When calling for verification of employment, depending on the law, the only legal answer is the dates of employment, nothing else.Bonita Nut Thanks this. -
If so, no past employment platforms(which are quite a few) would be able to have anything other than that.
If you said the driver sold fuel, they were charged and convicted you could disclose that.
If company policy for handheld device, like this where there is video of the violation, no problem.Siinman and Bonita Nut Thank this. -
Sorry it happened
The pic's show it not a driver facing can but a reflection from the forward facing cam.
The pic shows the screen lit up and the phone moving around.
Yes you are required to use a Bluetooth headset or other wireless devices BUT it's against the law to HOLD THE PHONE "anti texting laws" when driving. This includes dialing a phone number (1 button speed dial is ok). In my state TN you can and will get a ticket if the phone is in your hand when your driving..
BTW NC has moble roadside cameras that look down into you cab to see if your holdingyou phone on you lap..
That is what they got you for. In the future use a PHONE HOLDER..Siinman, Long FLD and Bonita Nut Thank this. -
Original poster, I used to put my cell phone in the bunk while driving. Now that I have a truckers app on my phone that has a GPS I do use it, MOUNTED hands free! I never touch my phone. I’ve also, set it up to be voice activated and even at that I have a headset these days you don’t need to touch your phone for any reason and you can still send messages via voice control. If you receive messages, you can have them play through the speakers in your truck , assuming your system has Bluetooth connection. You can literally send and play messages without ever touching your phone or even looking at it….and just have it stationarily sitting there to use your GPS on.
it looks like you were literally holding it because it’s in different positions, and that’s why they nailed you.Siinman, bryan21384, Long FLD and 1 other person Thank this. -
(I didn't think of the camera picking up the reflection, either, that's sick.)
Now you know, just always use a holder, you got a lot of good feedback here.
I'm not being judgmental, or prying, but by just resigning, that way
you have no worries with reports or records hanging, possibly for a year.
You just moved on, got a better offer, etc. whatever.
Had to take care of a bedridden Uncle.
Yeah, that's it, bedridden Uncle Silas.
Much cleaner exit.
I can't help but wonder your reason for not resigning?
Personal, and not for discussion, or is it something you could share?
Thanks, and best of luck.Bonita Nut Thanks this. -
Just so you know most forward Camaras can also see the nose mirrors so they can see you that way.
Bonita Nut Thanks this.
