Question about first offender act

    Hi, I just finished trucking school 3 weeks ago. I got my tanker, doubles and hazmat endorsements.
    Last year I was letting a "friend" stay at my house because his mom kicked him out because of his drinking. One night he got really trashed and I told him he had to leave and to put a long story short, we ended up getting into a scuffle. The police came and we both got charged with aggravated battery. I went to court and the judge was pretty reasonable. He gave me a year and a half of non reporting probation and tried me under the first offender act. They said I could get off early if I pay my fines and do my 80 hours community service.
    Well I tried to explain that to Werner and Schnieder but once I checked yes on the Felony question seemed like the application ended and I received the job declines by email. Now I have been reading about first offender act and it said once I complete my probation that my record will be clean. Sucks though that I will have been out of trucking school that long. I know it will be harder to find work. I'm not even 100% sure I should be checking yes on the felony question. I don't want to keep it a secret and then get fired if something shows up. Wouldn't that be visible to other employers that I was fired?
    My question is if there is anyone that has any advice or a similar situation. Does anyone know any companies in the North metro Atlanta area that would hire a temporary "felon"? Thanks for any input. On a side note, I take full responsibility for the situation. I should have never let someone like that into my house. I know I was a ####### for not just calling the police on him first. He got mad and went to a neighbors house and called the police and blamed it all on me.

    im no lawyer but a felony is if you are convicted to a yr or more in prison, misdameanor is when you are convicted to less than a year in county jail. since you never served time i doubt you have a felony

    Not a lawyer either but you need to talk with one, this is no place to find a good answer since no one knows your local laws like a paid mouth piece.

    where you convicted of a felony? If not, then why are you checking "yes"?

    Why not go down to the court house and get a copy of your records -

    Also next time you tell someone to leave and they do not... simply call the police and let them handle it. He does not live there and you did request he leave.

    Aggravated Battery is a felony in all states but can punishable by fines and probation instead of jail time depending on where you live.

    Its messed up u got blamed for your buddys idiodicy *i think thats how u spell it* U dont have a felony driver thats a misdemeanor u might have screwed yourself with werner. Do a walk in in court and ask the judge to expunge your record if u have completed your comm service tell him it is holding you back from acquiring the job you need to support ur family give it a shot it worked for me.

    u must have had a lawyer originally talk to him
    if your out a year before you can work you will have to take a refresher course too
    and every company will want to know your complete job history no breaks
    so make sure you are working doing something (not raking leaves for uncle bill)
    to show a consistent work history
    after 35 years self employed employers wanted a letter from my accountant stating such

    Good suggestion,hell the least he could do is drop it to a misdemeanor.
