Question about lease insurance

    Hi guys,
    Im kinda confused on this one, and need to clarify if this is right/legal. Ok, we run our own mc authority and have only 1 truck and other truck is leased. our truck is insurance under our company name but the lease one is under driver name. It's not under our company name. So if I doing load with broker and ask for insurance certificate holder, do I have to sent them both even though its not under us?? I ask the broker but they only want insurance under our company name but for this load is the leasing truck not our. IF something happen with the load, are we doing this illegal?? Im just confused over this. Your feedback would greatly appreciated!

    if something happens and he is operating under your authority you will be held accountable. the insurance would best be under your name but at least you should be listed as additional insured on his policy.

    the insurance needed for operating authority should cover all trucks operating under that authority, i would have it the company name, now if he pays for that another thing.

    you really should get some expert advice on this, you could be severly at riask.

    I think you are thinking about different insurances. If he is leased to you, running under your authority, you will be required to provide cargo and liability. That is what the broker is going to be looking for.

    You are likely talking about physical damage and bobtail insurance that he can get under his own name.

    I don't even know that you could find a company to write cargo insurance for someone without them having authority.

    And this brings up another question. Did you call your insurance company and get the driver qualified and added? Does he have proof of insurance with him? If not, you need to contact your agent and get him added ASAP. And I hope he is not running and under a load. DO NOT LOAD HIM OR LET HIM RUN UNTIL THIS IS COMPLETED.

    no bill, i do think she means liability. i know some jokers who do this. they are lucky. i never would do this had several ask over the years. you would be surprised at the ones with no cargo, or not nough cargo ins.

    I have never had a broker ask for proof of physical damage or tractor liability. They want to see cargo and liability - both legal requirements to have authority. And only sold to a carrier. So I can't see how the driver could these if he is leased. And if she is talking about tractor insurances then tell the broker to go pound sand.

    Sounds like the driver has his own liability insurance and is "leased" to them. Not really legal, but that doesn't stop half the yahoos out here.

    How could he get laden liability without authority? He may have un-laden (bobtail) but if that is the case then the OP is out of business even with a minor accident.

    You don't need authority to haul intrastate or exempt, just insurance.

    The OP's insurance will pay the claim - but it will be CHARGED BACK to the carrier - and they'll get their policy CANCELLED.

    And GOOD LUCK getting another one.

    Cancellation will get their MC suspended...

    Same result - OUT OF BUSINESS...
