Question about "Log book" ticket in Calif.?

    On Aug 30 I was driving east on I-80 from Sacramento, Calif. to Sparks, Nevada
    there is a scale outside of Sacramento called the Antelope Scales. I have prepass but they never have the system on so I had to pull in ( they only open once in awhile & only for a couple of hours) anyway Has I was waiting to go over the scale I touch up my log book. when it was my time to go over the scale I started across and once I cleared the scale & was at the lite to either leave or go around back they turned it to RED & asked me to BACK all they way back over the scale & go over it again! First off I think this was unsafe & uncalled for! they could have just asked me to go around the scale house & go over the scale a second time. Anyway I did back up and came across again. this time they said I was over on my drive line tires & to pull around back & come in with my papers. So I went behind & before I even had a chance to pull the air brakes I was surrounded by CHP officers! Then one hollared at me to get my papers & get into the office at once! which I was trying to do; he then hollared bring log book also. So I jumped from the cab & ran towards the office only to run into a officer waiting for me near my truck who grabbed the log book out of my hand & made me drop my other paper work. I picked them up & followed him into the office! Only to be acussed of tempering with my log book? then he showed me a paper showing weighs of some truck being over on the drive but nothing to show it was my truck? Then I showed him a statement from my company stating they are responible for over weights / truck problems etc! He then said well I am NOT going to charge you with the weight but with not keeping your log book up to date. which I disagreed with but he said be quit or he would RED flag me for 10 hours if I said anything else! Then he riped out that days log slip made a copy of it then told me to redon one for that day! which was the same has the one he riped up! after that he gave me a ticket for the log book & told me to fix my load. I told him I had to get someone to come out to help do that. anyway the helper showed up & we redid the load & I tried going over the scale but was told still over BUT he would NOT show me any paperwork on it or to prove he was right? Then we redid the whole truck & when we were finished the place was locked up & no one around except myself / my helper & two other trucks who were told they were over weight! No one came by & said anything to any of else? Not sure I was legal to leave or not? & no phone numbers on the building so I called CHP head ofice & they thought it was okay to leave so I did.

    My log book is always up to date I have been doing the same routine for over 10 years! I work on the clock not off of log book I get about 37 hours in a week. on Mondays & thursdays I go from Sparks (Reno) Nevada to Sacramento, calif. & return the same day & average 10 & half hours to 11 hours each trip on tuesdays & fridays I am in town (Sparks) doing local drops & do about 7 to 8 hours & off on weekends & weds.

    I cannot afford to pay any fine & I do not think I did anything wrong so how do I fight this? Calif. wants the fine paid before a court date

    37 hours a week your a local driver I dont think your driving enough miles either. You do not even need a log right??

    and, not smart touching your log book as you are going over the scale

    Sounds like they pissed you off and you pissed them off. But 100 air miles is local driving. gonna have to go to court.

    that can be alot of $$$$$$ for that violation......


    and whether or not you need a log book is now immaterial, you had one, that's all that matterd at the time !!!

    Yep.. if you are not legally required to run a log book and you are... it must be legal and properly kept. Good luck!

    Sacramento is more than 100 miles from the Sparks yard. Log book required. OP: how much is the fine?

    The lessons here for all wannabes/newbies reading this: 1) Scale your loads. 2) Zip the lips when talking to LEOs. Just let it ride.

    Sparks is under 100 air miles. The regs state air miles, not driving miles.

    I know this scale very well. While at my last job we drove a delivery 17ft box truck and passed the Antelope scales almost on a daily basis. We got pulled in once and had to re-shift our load. But since we were local delivery = no log book required and our location was only 1.6 miles from this scale. But it seemed that boy did the CHP give us some serious attitude. We delivered furniture and appliances, TV's etc.

    A former company I worked for where we drove a day cab delivering tires from car to big loader and truck tires, it seemed almost every time we rolled the scales at this location, we got pulled out of line for one thing or another. The driver I was with had 20 years experience and this was a local run out of Fairfield, CA to shops in the surrounding areas including Sacramento. Back then, the driver told me he was always getting crap from this scale location CHiP's. This driver was always well documented and never received a ticket but a few warnings about load balance, blah blah blah. Tires shift people.

    Best bet as mentioned above, keep your log book in order. I would go to court and be very prepared with your documentation to see if you can beat the ticket. Good luck.
