Question about "Log book" ticket in Calif.?

    I could of sworn that I read in the FMCSA handbook, that you could be 2 days behind on your log entries as long as you have 6 days previous logs with you. I don't have my handbook available right now so I can't check, but I'm pretty sure that's what I read.

    i believe they cant shut you down but you can still be cited for not being current

    I was in Lawrence KS that day (April 28 1992) my son was being born... I lived there while my wife went to school. Remember the old Gaslight Village mobile home park before Home Depot was there? I moved the houses that were in the way.

    I got a log book ticket for a log book not current... I had started my trip at 10:00pm 1/10/17 and pulled in scale at 7 am 1/11/17 i hadnt finished my trip yet that is why i had not updated my log book......im confused and pissed off now....was i supposed to pull over at midnight and update my log book??? Or are they in the wrong for ticketing me??

    It's not about pulling over at midnight, but that from 10p to 7a you would have needed a 30 min break. You should have updated your log to reflect that change of duty status. Sounds like you deserved the ticket.

    Did you stop anytime between 00:00 and 07:00? If yes, you should have updated your logs. If no, you should have because you needed to do your 30 minute break by eight hours after going on-duty.

    You don't have to pull over just to update your logs, but you do need to update them if you do stop.

    Yes, it counts against you and also the carrier you work for.

    Never touch your logbook in a scale line, your on camera, they saw you writing in the book in yline. means you were not current as far as they would be concerned, Im sure your attitude had alot to do with the rest of the stop.
