question about new hazmat backround check, need some info

    i got a cdl in 04 and drove for about 2 years, and havent been in a truck since, my cdl is still good through 2015 but i let the hazmat endorsement lapse. now recently ive been thinking about taking a refresher course and getting back over the road but something has just crossed my mind that might be a problem.
    a couple of years ago i was seeing a phyciatrist and taking paxil and ritalin for depression and ADD and had a bad reaction to the ritalin. i started gettting muscle twitches called "tics" i didnt know it at the time that this was a side effect of ritalin so I went to the ER thinking something was wrong. I was also smoking pot a few times a week and I thought maybe i had smoked something bad and it messed me up, so anyway, long story short ,after i told the doctor i was smoking pot he naturally put me in the psych ward to keep an eye on me where i spent the next 2 days
    now it has just dawned on me that if I go to get my hazmat endorsement back this overnight stay in the psych ward might show up on a backround check and disqualify me from driving otr. can this be true or am i overthinking the situation? can anyone shed some light on this for me? ive looked at the dot website and googled the subject but its just so complicated to read all that bs in the regulations manual. thanks

    Medical records such as being in the looney bin fall under the federal privacy act, but your pot smoking doesn't, especially the first time you get caught with it in your system when you're tested either pre-employment of randomly.
