question regarding hours of service 60/7

    Thank you Lvnchuck. You pretty much answered my question. So let's say if I were to stay on line 4 for an additional 2 hours and not drive I'd still be legal but just will have to get to work the next day later because I need the 10 hour rest correct ?

    That's correct. And the only way an 8 hr break works is with a proper 8/2 split, which is a little complicated. There are several threads here on the subject that can explain better than I can.

    Btw, you said you wanted to log legal, but by logging off duty at 830 and working till 9, you logged illegal again...

    The only hours that count against your 60/70 are hours logged on lines 3&4

    Thanks texTrucker, yes I want to stay legal and the reason I did that was because I was unsure but now that I know this information I'll will be sure to stay legal.

    Your log says you stopped driving at 7:45 PM which is within the 14 window. You can be on duty as long as you want afterwards as long as you don't drive which you didn't.

    You are using to different terms. Do you want to LOG legal or do you want to WORK legal?

    Logbooks are for you protection. They are so you can tell your boss that you need to get some sleep. They are not so the big bad DOT can force you out of service. You need 10 hours off duty everyday. 10 hours in a row. You need a couple of hours to shower and maybe watch a little tv and then 8 hours of rest. Driving is stressful. Stress builds up over time. You need a chance to relax.

    If an employer is wanting you to work your little but off show him your log and say "Sorry, out of hours."


    You start the day the second you report to work. (Like hitting a time clock.) The lunch break is a 30 min break sometime within the first 8 hours. Quitting time is 14 hours after you clocked in. Of that 14 hours, you can only drive 11. Do not turn it into something scary. It is just punching a time clock. You have to punch every time you change what you are doing. And you have to include where you are at the time. That all it is.

    Thanks everyone. That was very helpful. I got 1 last question, let's say it's Friday and I have worked all my 60 hours, can I legally work Saturday for 6 more hours and stay on line 4. No driving at all.


    Yes wooly Rhino, I want to work and log legal.

    Yes. You can be on duty forever. You just can't drive. Saturday you have to be done long enough to do a restart before you go to work on Monday.

    Thank you guys so much for your knowledge and help. This company just hired a new dispatcher and he really don't look out for the drivers he has. He just wants to send, send, send like time is limitless. I'm just trying to look out for myself because in the end its my ### and license.

    It shows you stopped driving at 1945. You are still legal.

    You only drove 90 miles. If you stay inside the 100 miles circle then you fall under the short haul rules. You are exempt from 395.8. You don't even have to log. Local drivers can use a time card or if the company says log you can use it as a time card and all on duty time goes on line 4, even driving. It's just a time card for local drivers. Now if you go outside the circle then you have to go back to normal logging.

    As far as the normal rules you can only drive 11 hours in a 14 hour window. You can park the 14th hour and work the docks all night long if you want. But you must take a 10 hour break before returning to work.


    Back to local rules....

    395.1

    Short haul you can only have a 12 hour day before a 10 hour break but there is an exception to that too.


    Other than that don't use squiggly lines on your log. If you do then initial it. It's perfectly legal and looks better if you use white out.
