I am a newbie here and had some questions I thought some of you might be able to answer. My husband and I went to school and drove for a short time in 2004 with CR. England. About a week ago we each received in the mail a notice that we were part of a settlement class in a lawsuit, Barrett Jasper v. CR England. We are both very ignorant when it comes to legal matters. Does anyone know anything about this?......Thank you! Janice

Looks like the attorneys have a phone number you can call, and the detailed FAQ i linked. Sounds like you might be in to receive some money out of it if you got a card. -
I, as a third year law student, cannot give you advice about a specific case. However, let me tell you a story. I have a friend who worked for Walmart. They did not know it but someone had filed a class action suit against Walmart and they were given an option to join the suit after the award had been made. She and her son both decided to except the award. It was only $100 but they had stopped working for Walmart years ago and it was like a bonus. Back in the late 70's, women who worked as Carman for the Burlington Northern RR received $40,000 because women were discriminated by the railroad because they are to weak to do that job. I believe they are but the law disagrees. They all got checks.
I believe this case has to do with drivers not being paid occurring to California law. It would appear that you are being offered a settlement for something you are entitle to. You may also go to an attorney and try to get more on your own. As I said, I cannot advise you to take the money and run but that is what I would do. -
Just because you may qualify if there's a class action lawsuit, doesn't mean you're gonna get any money.
I'm sure legally the law office involved is obligated to send out notices regarding the suit., -
This lawsuit is what is called an Opt-in class action lawsuit. That is why you received the letter. Most people are familiar with the Opt-out style of class action lawsuits and had anything actually happened there, someone would have contacted you with how to get out of it etc. This is dealing with the accusation that CR England violated minimum wage laws during training, on the job, etc.
GITRDUN45 Thanks this. -
What is CR England wins the lawsuit? Would the people that opted-in then owe attorneys fees? That has happened in past class action lawsuits.

The case is settled. Do you want your money? Yes? Then mail card indicating your acceptance of the terms. Must be received before June 9 so don't delay.
Except and accept are vastly different words. Maybe spell check gremlin got the law student.
NO! Class action participants do NOT owe money when a case is lost.Last edited: May 3, 2014

I would sign up for it. I'm glad to see this happen. We shouldn't work for free.
