A west Bountiful Based company that started in the construction business. They recently started an OTR division consisting of 7 or 8 trucks. These vehicles have been in the construction field prior to being utilized in the otr division.
I worked for them for about two months. My reason for quitting is two fold. 1- they forced dispatch. Running from places like Elizabeth NJ to Kent WA in three days was a 'normal' load.
2- They forced me to run while out of hours. For instance, my last run was from Cinnaminson NJ to Kent Wa. I arrived out of hours on Easter Sunday of this year. Called my dispatcher (Dick H), and made him aware of my Hours of service issue. Was told not to worry about it, and that I would get my restart. I unloaded (while in the sleeper... lol) the next morning.
He called shortly thereafter, telling me that there was a load going from Vancouver WA to two stops in Colorado. They needed to be there the following Wednesday morning. # 0500 and 0900 respectively.
I told him that i couldn't do it, that I was out of hours. He said, and I quote, "Just get my F*&^%$# load back to the yard, and I will take care of it..." So, I ran illegally back to west bountiful where their yard is. Cleaned out my truck, turned in my paperwork, and gave them their keys. At that time, they also paid me for the previous load. And hand written on the check was the payment for the load from Vancouver to west Bountiful.
Here's the kicker. They put on my DAC report that I abandoned the load. Yet, they had obviously planned on getting rid of me when I got back in the first place. (having paid me for the load when I arrived, as part of my final paycheck)
What can someone in my position do?
Any help with this would be greatly appreciated.
Oh, and as a side note... I have been with Knight Transport ever since. I hear all kinds of bad stuff about them. But I think it depends on your performance and your attitude. I mean they have treated me fair. They run my rear end off. (not forced though) and I really like the e-log thing. I thought I wouldn't. (having run paper for 9 years or so prior) but it records in real time. so it actually saves me about four or so hours per week.
I am not trying to toot their horn. But give credit where credit is due.

This fantasy called "No Forced Dispatch" I have no idea where that came from!
It's their truck correct?
You are driving someones equipment correct?
They get the loads for THEIR truck correct?
Then, whats this No forced dispatch deal?
Take what the owner of the truck tells you to haul!
BUT if you can't make the delivery due to logging tell them so! For some reason that's why we have that log book! If you are being dispatched on QComm or other on board systems there is a record. It CAN NOT be erased! It stays on the servers of the company that owns that satellite! If dispatch is over the phone get a dispatch buster tape recorder! OR buy a cell phone that records the call!
These will protect you when
#1 they fire you for refusing to follow FMCSA rules and will get you your unemployment!
#2 you have a wreck, kill a family of 5 and attempt to tell law enforcement that they forced you to run the load.
The worst they can do is fire you on the spot, out in the middle of nowhere!
But again how do they FORCE you to turn the key, push the brake release, put the transmission in a gear and turn the wheel to get out of a parking spot if they are not in the truck with you?
You can NOT stop at a DOT scale or flag one down because guess who will get the ticket and fine? It's NOT the company! If you don't believe me we have a DOT officer as a member of TTR and he goes by Diesel Bear! He'll tell you the same thing and so will the officer that's putting your arse out of service and writing YOU the ticket! He'll look in the truck for someone holding a gun on you hoping he can make a kidnapping charge for the points on his record and maybe a promotion!
Oh sure, you'll have to turn the DOT write up in to the company for them to take care of BUT guess who they will send the bill for the fine to or hold out of guess whose pay check? I bet it's NOT the dispatcher, or load coordinator or any of those other letters companies are coming out with!
Yes, I'm a hard case but this crapola No Forced Dispatch for company drivers is complete BULL SHEET! If you fell for it in an ad or from what a recruiter told you then I have 3 bridges in NYC, 3 million acres of beach front property and 200 miles of Illegal Ailen proof property in Southern Arizona for sale! All tax free I might add!

A quick call to the State of Utah D.O.T. or even the Federal boys and you'll fix his wagon GOOD!!! And there is a website that can help you fix your DAC i think its www.dacfix.com if not mistaken
