I do not own nor lease the truck. I do not have a business. I am just the driver(I filled out job application and they sent me to take pee test, 5 days later was called to do first run). Intra/Interstate runs. Company pays for everything except my food. I sleep in their flat bed truck. Company considering me "sub-contractor". No tax deductions from pay. No contract. Pay is 25% of load. Am I entitled to get get copies of Rate Confirmation? And if so, when should I get this information?

Sounds like they are running you as a company driver but paying you on a 10-99?
outonalimb Thanks this. -
Is this something normal? AND would they be required to give me copies of Rate Confirmations? How would I know they are not cheating me out of money.
-
At the very least they should provide you a copy of the rate confirmation when they pay you.
Or you could ask for it before you take the load to determine if you want to take the load. IF they truly believe you are an independent contractor, you can turn down a load.
That would be an easy test to see how they react. When they say you can't, That is when you have proof you are an employee not a contractor.Prom Night Dumpster Baby Thanks this. -

Humm... so if they wont give me my past Rate Confirmations from loads i have picked up and delivered? Or if I ask for a Rate Confirmation and then turn down the load.. this is crazy..ugh.. I am the only driver for this "company". I have had a hard time just getting pay stubs for money they have paid me ("because computer was down") then they finally give them to me and they are all jacked up.. no holiday pay mentioned.. ect.. but checks have "Holiday Pay" on them.... I am so confused..crap -
Sounds VERY shady !!
goin2fast10 and outonalimb Thank this. -
If you are happy do not worry about it..All companies lie!

25% of $3.00/mi is great. But, if they say their loads only get $1.00/mi, then they are cheating you.
-
Thanks. Here is the thing, Only information I have gotten from them is on my pay stub.
example: from Tx to NE - amount $600.00 - payment 25% = $150.00 So I got paid $150.00
I have no idea what they got paid for the load because I never see any paper work (Rate Confirmation) -
Watch your miles and see how much you make....if he is honest it will add up.
He may just be bad with all the BS stuff....outonalimb Thanks this.
