I'm not arguing with you. I'm proving you wrong with the facts that you posted. Some people just can't handle being wrong I guess even when the facts they provide are used to prove them wrong.

You're the one that needs to get your story straight. You can't run it on the highways in Texas - period. Doesn't matter if you have farm tags or not. The only time I'm aware of that the IRS has granted waivers is during some of the hurricanes in certain counties where fuel availability was limited. And then they still expected you to remit the taxes that you should have paid on it.

Here's the way it is boys and girls. Every gallon of fuel that is going to be used on the highway has motor fuel tax tagged on to it. You can go search and get the map of the states and see the total of taxes for local, city, state, and federal tax. Right now CA is the highest at 66.1¢ per gallon and AK is the lowest at 29.6¢.

Off road diesel or dyed diesel has none of the motor fuel taxes on the product. IRS can fine you and other law enforcement agenices can also get you. When you use dyed diesel on the road you're not helping to repair and keep up the highway. Of course we all know it not a perfect system but no tax is dangerous if you're on the road.

If you have farm use equipment then you need to find the requirements for your state.

For example if you are hauling hay, farm tractor, livestock, farm exempt materials etc you can run a farm vehicle with farm diesel on the highways.I already contacted Tx Dot friday. My father and I have several farm plated P/U's and we run all red diesel since we have bulk fuel tanks at our farm.Farm trucks are meant for the farm and for anything that needs to be brought to or shipped from the farm! Notice all these farm tractors running on the side of the highway every once in a while? 90 percent of em have red fuel inside their tank(s). However you cant just go take your ol lady out to eat and then to the movies then a night out cruisin around the town cause thats different so both of you need to get your stories straight :smt117:biggrin_25523:

A “registered” vehicle, meaning one with a license plate cannot drive on any road, anywhere, for any reason with dyed fuel except in some remote parts of Alaska is my understanding of the law. Tractors are considered except because they are not “registered” and don’t have a license plate.

I think whoever you talked with at DOT is clearly mistaken (DOT isn’t exactly known for hiring rocket scientists lol). It would be real interesting if you could call them back and ask how the State of Texas has the authority to ignore/exempt Federal fuel tax on “registered” vehicles because I’m pretty sure they don’t short of a revolutionary war against the federal government.

You're wrong. But I don't really care what you do. You and your daddy can run red diesel on the highways if that's what you want to do. When you get caught, you can always plead ignorance. They won't be able to argue with that.

I checked some old fuel receipts. Both charge the same truck and reefer. Neither one charges sales tax. That's what the receipt shows. So the only conclusion I can come up with is just a seperation between the two purchases for future tax filings. To think you are getting instant savings at the pump... Nope!
