If a driver who is in a Pick-up pulling a trailer that is regulated with a DOT number is stopped for a roadside inspections. Is it the norm for the DOT officer or port officer to ask this driver where he slept other than a city if it considered to be his 34 hour restart.

Obviously no sleeper berth, so at any given time off duty they stay at a hotel. Can a the driver of that pick up truck drop his trailer and use the truck for personal duty without having to show where and what location he was at, if he stayed at a friends while in town.

    Dianna,
Since no one else has jumped in here yet, I'll give it a try. Yes, I believe the DOT can ask where the driver slept, and the driver might have to prove that he did not sleep in the truck that does not have a DOT approved sleeper berth. However, I'm not really sure how much "personal" information a driver is required to give regarding where he/she did sleep.

Do not be surprised if you need to come up with hotel receipts or if DOT wants to call friends/relatives that you claim you stayed at. I can guarantee that would happen in the event of an accident that involved an injury or death.

Yes, the driver can drop trailer and use truck as personal conveyance. He/she would need to log where the trailer is dropped as location of 34 hr reset.

You might want to check with some of the hotshot message boards for more information. Try googling hotshot hauling or something like that. Those guys typically use a 1 ton truck with a 45-50 ft trailer and deal with issues like you are asking about all the time.

    Hope this helps!!
