Hi, I was wondering if anyone here has knowledge about sales tax exemptions in New York, specifically for truck purchases.
I recently purchased a used semi-truck through a loan from Missouri, where there is no sales tax on truck purchases. I’ll be operating under a Missouri-based company using its DOT and MC number. However, I reside in New York and was told I only need to register the title here.
My question is: Do I still need to pay New York sales tax when registering the truck, even though it was purchased and financed in Missouri for use under a Missouri-based company?
Unfortunately, the accountant who handles my taxes doesn’t seem to have a clear answer, so I’m feeling stuck.
If anyone knows a good accountant who understands trucking businesses and New York state tax laws, I’d greatly appreciate a referral.

If the business is located In Missouri, then Missouri tax regulations apply. Hopefully you have yourself classified as an employee of your company. Your company should be withholding (personal) income taxes for the State of New York, at NY rates, because that is your personal residence. That is my understanding, I am open to correction.

NY has a rolling stock exemption, it can be applied for through the DMV for interstate trucks.dosgatos Thanks this.

Does any state not have a sales tax exemption for trucking equipment? I thought that was a pretty universal thing.

South Dakota doesn’t. Nebraska doesn’t unless you’re a motor carrier or leased to a carrier from NE. Those are two that I know of for sure.

Nebraska sounds like they do exempt the sales tax...with a small amount of documentation proving the equipment will be used for trucking and not as a personal toy. I think Indiana is like that too. -
I live in NE and didn’t qualify for the exemption when I was leased to TraLo because they’re based in MN. South Dakota is 3% when you license it the first time. It’s not as bad as it sounds.

Yeah that’s not too bad. NE actually sounds like the rip off. If it’s a vehicle used for interstate commerce it should automatically be exempt. Most states are like that.
