Scale house forcing drivers to pay fine on the spot or else

    A friend of mine got an overweight scale ticket from a city weights and measures officer outside Chicago. He had to get the company to cut him a $3000 Comcheck on the spot.

    I remember Louisiana doing this untill the Fed's shut'em down for a minute due to the whole due process issue

    So you want to know what to do if the ScaleMaster says you're over, in violation...etc and have to pay now before the truck can be released. Right? Because if you pay now, there's no due process, correct? Extortion. Highway robbery.

    I don't know if this is the right way of doing things, but this is how I deal wth highway robbery.
    1. I'm not signing anything. You're going to have to arrest me and take me to jail. I will post bond. I will have my day in court. How much is bond? Much cheaper than the ticket.
    2. Get back to your truck, go to a completely different Cat scale ASAP, weigh your wagon and compare the 2 scale tickets. If Cat scales were accurate, they should read pretty close to the same. Should be.

    A lot of these states got around the due process thing by changing the wording. You aren't paying a fine on the spot. You are posting bond. Then if you plead guilty by whatever method they use, the bond is applied toward your fine. Just a play on words to get the cash up front.

    In florida and Georgia they just issue the company a citation and you have 30 or 60 days to pay. Know a guy that was in SD and they said either pay or get the truck impounded. Sucks

    With this you think your truck is going to stay at the scale while your taken to jail?

    I would think it if came to this, it would be stored for you at a tow yard...

    Add in those fees? Not to say I'm right, but just a thought

    I think there is a misconception about the Cat scale policy. The only way thy cover a fine or go to court is when you file a complaint and thy find that there scales are off and only then will thy be willing to back you up. And I get the felling there's not snowballs chance in heck it will be off by much.
