625 ILCS 5/15-112(f) Whenever an axle load of a vehicle exceeds axle weight limits allowed by the provisions of a permit an arrest ticket shall be issued, but the owner or operator of the vehicle may shift the load so as to comply with the provisions of the permit. Where such shifting of a load to comply with the permit is accomplished, the owner or operator of the vehicle may then proceed.
In other words, under Illinois law, they CANNOT hold you there demanding payment. Once you shift or reduce the load to make it legal, they MUST let you go on your way. Period.
Also of note:
Under 625 ILCS 5/15-112(d), if you're less than 2000 pounds over on an axle, but your gross is OK, they must allow you to shift the weight to make it legal and they cannot cite you. Again, that's the law.
Then there's 625 ILCS 5/15-112(e) which says if you're weighed on a platform and are less than 1000 pounds over gross....or weighed on portables placed under the wheels to weigh individual wheels and you are less than 2000 over gross...they must allow you to reduce the load to make it legal and they cannot cite you. Once again, that's the law.
If you've got an APU, 625 ILCS 5/15-112(e-5) is the allowance for 400 pounds (or the weight of the unit) over the legal limit for axle, gross, or bridge...but does NOT allow the extra weight to be on a towed unit. So you've still got to have your trailer legal, but can buy a few extra pounds on the tractor. You've got to have written certification showing the unit's weight, and you may need to demonstrate that it is fully functional...but if you meet the requirements, you're good.
All in all, Illinois isn't really all that bad. You've just got to know the rules of the game you're playing. Even the fines aren't all that bad as long as you're SOMEWHAT close to where you ought to be...bbechtel16, G13Tomcat, TripleSix and 3 others Thank this. -
