    Had a driver overweight in NY once.... Or maybe it was PA. Anyway, He was pushing 95,000 if I recall correct. They gave him a summons and let him roll as is. We plead guilty, mailed the summons to the court and the judge set the fine and the court mailed it to us

    Another time I had the wrong trailer on my oversize permit. That was in PA. Super Leo said I was a flight risk because I wasn't from the USA therefore he was taking me to jail. As we know they can do whatever they want then we get to spend thousands....... in some cases to prove that a charge shouldn't have been laid at all. But they get paid nonetheless.

    Have you ever posted bond before? It will take the cop longer to fill out the paperwork than your stay in jail.

    When someone is trying to bully you, they are bullying you because they believe that you will give in. Give him resistance and the bully will look for easier prey.

    wasnt me,but the scale put the driver OOS for 10,then had another truck come and off load down to the proper weight,and gave them 1 cahnce to get it right.

    There shouldn't have been any time specified on the OOS unless there were log book and HOS issues as well. You're only held until your weight is legal, and then you can leave. If it takes you 20 tries, then it takes you 20 tries. All the officer can do is either write you an additional citation at every failed attempt (which all but the first will likely get tossed, making the cop look like an ###) or refuse to weigh you again, in which case a phone call up the chain of command will usually change his mind when his supervisor calls asking why he's refusing to reweigh a truck that can't leave 'til it gets its weight correct. Again, makes the officer look like an ###. Granted, it takes a certain level of incompetence on the driver's part if he can't get it right in a reasonable number of attempts.

    dont know,but that was what I was told.22000 over on a straight truck rated for 33000 is ridiculous.

    they did it,alot of bags of flour and tins of pasta sauce.8000 fine im told ,lol.
