    When I came back a second time, It was forced on me In 2015 for 90 days but wasn't in 2013 when I first started

    Hm. So maybe they've made it optional. They love the drivers who do it, I'm sure.

    I still don't see how any of it's legal. I thought for SURE they'd have been smashed in court on this by now.

    Then again, the trucking industry just does whatever it wants to its employees, for the most part.

    then please explain why there was a difference in total income in the sic security column vs taxable income column on my w2 that year?

    I don't follow what you're saying. If there was a difference, it would be that your taxable income was lower, and thus your social security benefits would be decreased. You get what you put in (in a perfect world).

    no. the income shown for ss was higher by the same amount that was paid to me as per diem.
    in other words SNI and I paid into ss at the correct total wages but per diem offset my taxable income only

    I don't see why they would do that. Per diem lowers your taxable income. So your Social Security burden should have been slightly less as well. Maybe it's such a small amount that it doesn't matter in the short-term, but long-term it could affect the money you get back.

    maybe they arent allowed to short change fica via per diem. all I know is my total wages were considered under fica. while the refundable portion reflected the per diem taken out.
