SCOTUS overturns Chevron deference ruling

Well at least once the issue is settled in court you don’t have to worry about it changing every 4 years. Good, bad or indifferent we can work with. Uncertainty and the fear of unelected bureaucrats with a changing agenda every election cycle strangles small businesses

 

It will potentially change more frequently and with less advanced warning.

 

Doubtful.

 

There are over 10,000 precedents covered by Chevron. That's a lot of opportunities for judicial activism.

This benefits large corporations, not small business.

 

This benefits all Americans who don’t like three letter agencies ruling by mandates. If it’s not stated in the law they can’t just fill in the blanks. And your assumption that the courts will just fill in the blanks is a straw man argument. It will more than likely get sent to congress to figure it out. But even if it doesn’t I am more comfortable with the courts interpreting the law than say idk a former mayor of south bend Indiana that was appointed to his position because he was a loyal water boy. That and he checked one major box on the progressive agenda.

 

Case and point, EPA "cleaning up" a Contained leach pond and spill it into San Juan river, poisoning everything in it for miles. OOPSIE ! government agency no repercussion
Or the ATF at Wheeler Ridge, they shot 3 people and a Dog that did not have arrest warrants. 2 of those were unarmed... Weavers wife was holding a baby and shot in the back, and the dog was not attacking, merely barking at agents preparing to storm the cabin. BTW Weavers warrant was based on an agency snafu, much like Waco, no real weapons violation but ATF acted on statement of delivery driver. And stormed compound without warning.....

Judicial rulings are no where near as fast as government agencies mandates
Such as FMSCA elogs "hint, hint,nudge,nudge say no more "

 

Guaranteed anything that pertains to trucks from a 3 letter government agency will not be stopped……….

 

And when it's someone like Mayor Pete on the bench, are you still comfortable?

You will never confince me that judge made laws and regulations are good - even when they make rulings I agree with. I believe the executive branch is easier to hold accountable than judicial appointees who are virtually unfireable.

 

What about expanded?

If I recall correctly, the appellate rulling in the OOIDA vs eld case the judges seemed to think the eld mandate didn't go far enough. If anyone thinks this ruling will only result in regulations being voided, have another think. It will be used to create regulations/practices like qualified immunity.

It wasn't too long ago "judicial activism" was anathema to conservatives, and for good reason.

 

What about Appleton Coated dumping millions of pounds of carcinogens into the Fox River? That's a Chevron covered case. There's a lot of folks by me who claim it's the EPA and WI DNR that have killed the paper industry, and that's just not anywhere close to being true.

We can moan and tear our hair about all the bad things government does, but we should also admit when it does work for us. All this ruling does is give more power to large corporations.
