He does .....he can simply say a truck with non English speaking driver is banned from hauling commerce.......they can do the test on the spot at the shipper to verify.....

So dumb Duffy is taking credit for Trump's executive order?
I would not credit him for that. Trump deserves the credit.
Maybe even Tom Holman, who told clued Trump into the situation deserves credit, but not Duffy who had have his arm twisted to even make a speech on it.
Duffy doesn't even need Trump's executive order to shut down all the non-english and non-domiciled drivers. He hasn't even read his own laws, as demonstrated by his speeches.
When Duffy shuts down 7,000 carriers hiring these drivers, I will say he has done something. 7,000 drivers is a small start and credit belongs to Trump, Holman, and local law enforcement.Arctic_fox Thanks this. -
He has no rules on the book to go after shippers loading non-english speakers.
He cannot make private shippers law enforcement officials.
Just think about this a minute, and you will realize how dumb it is. If you make shippers responsible for each truck driver's English proficiency, each and every shipper will be forced to give English tests to each driver. You will be standing in a long line, in the rain, at the guard shack, behind Abdul, Mohamed, Sing, Chin, and Rodriguez, each getting recorded as they read a chapter from the Dr. Suess so they can pick up a load.
It is absolutely ridiculous and shows how stupid Duffy is for even suggesting it.

I mean you made the post, and I do appreciate it and the conversation, but now we are supposed to turn today's issues into a hate Obama fest? Plenty of reasons to do that, but I am much more interested in the Clown we got now as Secretary of Transportation.
So a bit of background on the issue that I am sure you are not aware of. Around 2001 Baby Bush'a secretary of transportation put out a memo stating that the Department of Transportation will not be enforcing the English language proficiency rule at all. No tickets! No OOS! That memo circulated around trucking sites, including this one. I don't know if can go back far enough in the search to find it, but you can find truckers and commercial motor vehicle enforcement officers talking about on this forum.
Around 2005 the CVSA recommended that the ELP be enforced as OOS after several studies showed how dangerous these non-english speaking drivers are . However, the Department of transportation supersedes the CVSA and drivers were not being cited for the issue. By the end of the Bush administration only infractions were given. The FMCSA, yes under Obama, made this policy official in 2016.

This is a bi-partisan screw-over. ELP has not been enforced in years.
Did you know states used to hire interpreters to take the CDL tests during the Bush years? When the interpreters got caught cheating, even when in relation to a human trafficking scheme, Bush refused to prosecute the offenders and remove the provision allowing interpreters for the CDL. Obama did.
Duffy has nothing for rules to go after shippers, That is just stupid. It is a ridiculous, un-workable, stupid idea Duffy is stupid for not realizing that.
Duffy has over 7000 leads to go after carriers, and has not cited, suspended, audited, or revoked authority of even one carrier. -

FMCSA has no authority over shippers and receivers. So how, exactly, will the government “go after them” for loading someone that can’t communicate? That’s like saying they’re going to hold shippers responsible for hours of service violations.
I am 100% behind getting all the non-qualified drivers off the road, including citizens that basically paid for a CDL and can’t drive, but all this grandstanding really should stop. It’s starting to get retarded.Siinman, Toomanybikes, Concorde and 1 other person Thank this. -
