Shipper griped about securement, threatened to remove the load..

    ive had forklift guys tell me they dont want something secured the way i was doing it. or i put too many straps over it and their "better" ideas of how to secure something is not legal.. 4 straps lightly tightened over a 48ft load that weighs 40k... dude f off, go ride your propane tank around... i secure to what's legal and what i think is safe.... whether thatsthe way they like it done or not , i could care less.

    even then, how is a lawyer going to exploit the fact that its 100% the drivers responsibility for the freight? shipper has 0 responsibility once it leaves their property.

    The same way they get a mega million dollar judgment against a company who's driver was entirely legal on hos, nothing wrong with the truck, simply had the misfortune to be hit by their client who was driving down the wrong side of the road down the interstate. We're not living in a world with logic and reason anymore.

    i get what your saying. but all the big mega lawsuits have been because the company and or driver cut corners somewhere in the process.

    While true let's remember Werner.
    A pickup traveling south on (I believe) I-45 hits an ice patch, looses control and crosses the median and hits a Werner truck north bound. Even after being hit the Werner driver still keeps control of the semi. Of course the pickup truck driver dies. Werner looses a lawsuit for 92million.
    Or the company that rented their trailer to another trucking company. 100% legal and compliant and when the other company was in a fatality they had multiple millions against them because they owned the trailer.
    The shipper knows they will be sued if something happens, so they want to make sure they cover their butts.

    the werner case if i remember correctly is it was a student in training and the lawyer representing the deceased, convinced the judge that the truck driver didnt have enough experience to be driving in those conditions and thats why his client died... which is a crock of ####. the werner case is the only one i can think of that was ridiculous... the one that got sued for brokering out their trailer, they were not legally set up to broker loads if i remember correctly... a case of cutting corners and paying dearly for it... and that owner op car hauler that got the 410+ million judgement against him was on his phone when he wrecked

    And all they have to do is convince the jury the shipper is the reason the load wasn't secure, should be easy enough to do if they can get the driver on the stand.
