Short Haul/16 hour rule question

    I've recently been doing local driving. I return to the same terminal at the end of each day. My question regarding the 16 hour rule is do I get one a week or one with every reset? For example if I use my 16 hour day on Friday and get the weekend off can I use a 16 on Monday or do I have to wait until the 7th day?

    Yes you can! Until the new HOS rules go into effect on July 1. After July 1, only one time during a 70.

    Does that have to be logged as "off duty"?

    Yes. Chances are you don't have a sleeper to log line 2 with.

    There is NO change in the 16 Hr exemption. It can be used once a week unless a driver gets a reset, then it can be used again.

    o) Property-carrying driver. A property-carrying driver is exempt from the requirements of § 395.3(a)(2) if:

    (1) The driver has returned to the driver's normal work reporting location and the carrier released the driver from duty at that location for the previous five duty tours the driver has worked;
    (2) The driver has returned to the normal work reporting location and the carrier releases the driver from duty within 16 hours after coming on duty following 10 consecutive hours off duty; and
    (3) The driver has not taken this exemption within the previous 6 consecutive days, except when the driver has begun a new 7- or 8-consecutive day period with the beginning of any off-duty period of 34 or more consecutive hours as allowed by § 395.3(c).

    Returning to the same terminal every day doesn't mean it's a local job. I'm willing to bet you have a line haul run.

    *sorry for the side track, but using terminology incorrectly is a minor pet-peeve of mine*

    Something local would conclude that you never leave a metropolitan area, hence the short haul logging exemption.

    Doesn't matter what he calls it as long as he departs from and returns to the same location the previous five days he can use the 16Hr exemption.
