1. Attention employers: We now require a valid DOT# for anyone wishing to post a driving position. If your job offer doesn't contain a DOT number, it will not get past moderation and will not appear in the forum. The other requirements in the sticky at the top of this section are still required as well. Thank you for understanding.

OK here goes, I received my CDL July 6, 2007 and began to place apps everywhere I could, on the web,apps......etc. I have been receiving copies of the background reports from USIS in Tulsa OK from trucking Co inquiries. The reports do not have a felony I acquired in "95 (attempted poss meth) and the one that seems to keep me from getting A JOB. At this point I feel I should not put the '95 incident on any more apps. Maybe someone can advise me that has experience in this area. My question is ,should I withhold the '95 felony information or SHOULD I TELL'EM ANYWAY ?:biggrin_25511:

    Shaman,

Welcome to the best trucker forum on the net! That is a very good question there. I tell ya...I, for one, don't think that a man should have his life ruined for something that happened 12 years ago. IF that felony doesn't show, I wouldn't tell it. That is NOT legal advise, it is just MHO. So did you have a FULL background check run on yourself and it's not there? I would spend the $60 for a full background check for peace of mind if I were you. IF it is there, then I WOULD tell them.

Of course, I am assuming you have been clean for 12 years...I certainly don't want truckers on the road taking drugs or anything of the sort.

Have you been in recovery programs? Just wondering as you may want to put down that you've been in recovery since then. They may be wondering if you still mess with the stuff. Most employers look favorably on people who have gone through or are in recovery programs. I've never had a problem with mine. I just tell them I've been in recovery since 92 and it's something I'm very proud of. If you just put down that felony I would almost bet they're wondering if they're about to hire someone who's going to use on the job. I think the choice is up to you but I sure wouldn't want a boss to find out later. That would damage my credibility, integrity etc. IMHO

I would get my local PD or State trooper to pull a back ground check if it shows up on your criminal record then i would include it on any application. I wouldn't put what it was for but i would list a felony and see what they said if they were interested in further Information.

I did have a criminal back ground check ran at the local PD and returned a , "NO CRIMINAL HISTORY" on the check up. I don't know what is going on there so maybe I'll try a lil white lie and not put the '95 felony down from now on, welcome any random drug test they want to throw at me. I have been clean of drugs, NOT BEER LUV BEER, for over 10 years.:yes2557:Keep the replies coming though

From any apps I can remember, it seems that they only ask for this information 5-10 years back. If they aren't specifically asking for any farther back, on the application, I wouldn't say anything.

any time any company runs your dac they(dac) must by law send you a copy you can dispute any errors.sometimes this takes a while. some companies say they only go back five or ten years. not if it's a drug charge. it's a forever. just my opinion look for a smaller company where if it ever does come out hopefully you'll be so valuable an employee they won't want to let you go.
I don't advocate lying but like shaman said you did your time your clean but these ######## never let anything go . THere are lot of companies running untrained rookies (sorry) instead of seasoned pros just because of something that happened years ago. heck even childsupport has an expirtion date!

If you come back clean arent you more likely to run Canada than a driver they know cant go?

I would worry for this reason. I also have a felony, 20 years old, bad checks. I was working for an auto repair shop at one point that caused me to have an odd week. That weel I think you will find interesting.

I got my DL ran early in the week. It came back clean with no problems at all. 3 days later it got ran again. Same cop, and now it said I had an outstanding warrant for a bad check from 1987. **This was in 1998** Turns out they would pull the warrant every few months then re issue so it didnt "expire". I'm not sure how that works out legally. And since I had already been convicted of and completed the sentence for the check anyway I had a nice littl fight on my hands. If you choose to not disclose it keep an eye on your report for a while. Should they elect to send you to Canada and it be found at the border....well enough said there.

I personally dont trust their reporting systems, methods or ethics. So I told my recruiters about everything I thought might be a factor, no mater how minor or how old.

I usually am a proponent of being upfront about past issues, but the fact is just as Bullwinkle says, apps don't usually ask about your entire history, just certain periods - maybe 3 years for tickets, 5 years for accidents, and 10 years for criminal charges.
Though I wouldn't volunteer it, if the app says have you EVER been convicted, been denied, etc. then yeah, you need to 'fess up.
Don't use the DAC report as a guide, that is only for your trucking job history, not your personal history.
