Should shippers that have wait times be required to supply a safe haven

    You're right, in the highlighted part. However, you do not have the right to violate the property rights of the shipper/reciever becasue you're out of hours. If I was driving down your street and pulled into your driveway as I used up my HOS, would I have the right to stay there? Of course not, and it's no different for a business.

    The solution to this is leaving the facility with enough time on the clock to reach a safe parking area, whether they have finished with you or not. If more companies had balls when dealing with these customers, this crap wouldn't be an issue. And the cop is only enforcing the law, it is not his fault you don't have enough hours per FEDERAL REGULATIONS to legally leave the premises. Getting his badge number and trying to get him fired will only succeed in making you look like just another truck stop lawyer. I don't know who's telling this kind of stuff but they are full of it!

    It's garbage that this goes on, but in the eyes of the law, failure to adequately trip plan does not allow you to stay where you please. Mind you, if we all planned for the worst case at every stop, we'd have our books so screwed up we'd never get anything done. Welcome to trucking, ###### if you do, ###### if you don't.

    Not if you've used up your 70.

    You can work 40000 hours straight if you like, as long as you don't drive. There is no limitation on line 4 hours. It's just like your 14, you can work 16 or 18 or whatever, just don't drive til you've had the proper break.

    Yep. It sucks. Until carriers get aggressive with the customers, nothing is going to change. But the answer isn't demanding parking. BTW Safe Haven is a term used for HazMat loads, not for safe truck parking.

    safe haven is whatever I deem it to refer to for the purpose of this thread :p (being a smart mouth) and clearly this is a good thread as it had reached 4 pages, and appears that it touches on a issue that every driver has delt with and will continue to deal with, no matter how well they trip plan, no it won't happen every day week or month, but it will happen, and we can't just drop the trailer in the doors, and I'm pretty sure most of us who work as company drivers would get fired if we told the customer we are out of hours, and gonna have to leave, and they can finish loading/unloading after I have my 10 hour

    That's pretty much the truth right there and one of the things I love about working for a private carrier. I've left many a place because they tried holding me up. If they want our product they better be ready at the appointment time or we're gone.

    The places we go know this and don't screw around with us 99% of the time due to this. Generally, we only have issues with the few shippers we go to hauling product back to the plant and they have genuine reasons why the product isn't ready to go. The problem is with general freight it's not really an option. Transportation isn't how we make money so we don't need to satisfy a customer in that fashion.
