Yes the company should be keeping their cut of the FSC. They keep their percentage of the insurance portion of the rate, the administrative portion of the rate and so on.
Personally I am not a fan of FSC at all. The rates as a whole should go up to reflect the actual increase costs. Not just fuel prices have risen. Labour costs, insurance costs, repair costs, lights heat in the office and on and on. We don't have a labour cost surcharge.
The transportation industry is hurting themselves with this system of fuel surcharges. Just raise the freaking prices already and pay your people what the deserve.

Yes, FSC is supposed to go to the O/O, all of it, but, brokers especially will manipulate the fee to their advantage, hence, flat rates, as they say. BTW, any rate is negotiable.

Any and ALL deductions have to be explained in black & white in your lease... If they are taking a % of somthing it must be spelled out in the lease.. If it is not there.. they can't do it!
On the flip side if it is there and YOU signed (thereby authorizing them to do so) YES, they can.
My understanding is that whoever pays for the fuel is suppose to get the FSC.. I had 1 company try to claim they bought the fuel.. (via comcheck when they "advanced money" on a trip.. they were buying it, YOU weren't purchasing it until the trip was turned in and processed. Then your advance would be "paid back" to the company for the load)...
That company took 100% of the FSC! I don't know if they still do it was like 7 years ago..
